naturalisation porblem - Traffic offance/court fines other

Post by MKR_73 » Wed Oct 20, 2010 11:58 am

Traffic offance/ no insurance/ driving w/o licnece/ accumlating points on licence

What is Good Character

Requirement for good character must be reviewed
Look at the article below

"Labour’s deputy leader was fined £350 and had three penalty points added to her licence, bringing her tally to nine, three short of an automatic ban, after admitting to driving without due care and attention. The maximum penalty would have been a ban, nine penalty points and a £5,000 fine. "

the requirement for Good character must be review and challenged due to the number of migrants are bared from naturalisation under traffic laws.

Note that Rehabilitation act does not apply for points endorsed on you license. It is the "FINE" part of sentence that carries 5 year rehabilitation period under the act.

It is too harsh on migrants that a person with "Bad character" or "criminal" by HO definition is allowed to run the country but poor migrants, who give 100% to the country, are barred from naturalisation.

Any comments are welcome

Good character is a requirement for applicants applying for British citizenship, not for those who already have it (citizenship)!

Do 9 points on licence lead of revocation of citizenship of migrants but not of non-migrants? Or are the penalties different for migrant citizens and non-migrant citizens?

A grudge?

I think migrants should drive better
Seriously, even on these forums - the amount of people enquiring about their chances for citizenship when they have driving offences or did not pay for insurance, etc - it's just scary!

But that is no evidence that more migrants than non-migrants commit these offences. Such people (migrants) post on the forum because their eligibility to remain the UK (extension / settlement / naturalisation) may be influenced by the severity of such offences. Whereas, non-migrants do not need to post such questions on forums. Therefore the comparison, based on number of posts, is flawed.

This said, I believe everyone must drive carefully! :D

My initial question is about definition of Good characteristic imposed on Migrant. It is about any Fine issued by court which becomes spent after 5 years. Does it mean that if i dispute on parking ticket and take matter to the court and then loss and handed in a fine, I will be barred from naturalisation for 5 year? It means I am not able to exercise my basic rights.

Your basic right is to challenge a charge imposed on you. Being found guilty in a court of law cannot be misconstrued as "not being given the freedom to exercise basic rights".

Acquiring citizenship is a privilege, not an entitlement. As in UK, it would be the same in your home country. And laws specified for the purpose (in any country that one wishes to acquire citizenship of) must be followed - whether one likes it or not!

It is human tendency to use the "discrimination" label when affected.

Well, it is true - but I suspect that migrants have issues adjusting to UK roads (different rules and for many different side of the road, etc). Natives don't have the same issue.

Indeed!

There is no basic right for citizenship. Lack of one does not prevent you from anything basic (and in fact from anything particularly serious - apart from visa-free travel and voting).

I agree - and driving without insurance / licence / drink-driving etc are all just half-witted and selfish things to do. That applies to everyone, citizens, ILR holders, visitors, etc.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

Labour aren't actually running the country at the moment, having lost the election!
