Naturalisation (Spouse of British Citizen) – Absences & Exact Date Rule – When Can I Apply?

Hi Admins/Moderators,

I’d appreciate some guidance on eligibility of my spouse for British citizenship (naturalization) as the spouse of a British citizen.

Spouse Background:

I now hold ILR
I am applying under the spouse of a British citizen route (3-year residence requirement)
My spouse is a British citizen
My concern:

I understand that:

I must have been physically present in the UK exactly 3 years before the application date
And must not exceed:
270 days absence in the last 3 years
90 days in the last 12 months

My travel history:
23 March 2023 – 13 September 2023
→ ~175 days outside UK

17 April 2024 – 30 June 2024
→ ~75 days outside UK

15 March 2025 – 27 April 2025
→ ~44 days outside UK

My understanding:
Because I was outside the UK until 13 September 2023, I believe I cannot apply before mid-September 2026, as I would fail the “exact date” rule.
If I apply on or after 14 September 2026, then:
I would meet the exact date requirement
My total absences in the 3-year period would be about 119 days, which is within the 270-day limit
My question:

👉 Based on the above, is it correct that I should wait until September 2026 to apply?

👉 Or is there any scope to apply earlier using discretion?

I’d really appreciate any confirmation or advice from those with similar experience.

Yes, you need to wait until September 2026. There is no to very little discretion to waive that requirement.
