help in british citizenship application

Post by babbal_samrat » Tue Feb 16, 2021 3:46 pm

Hello All,
i would like some advice and guidance on applying for british citizenship.
have indian passport,
i have ILR in my indian passport. I have had ILR since Aug. 2008, my this passport expired in 2012, and i renewed my passport from Birmingham indian counsulate. but my ILR still remained in my old passprt. i did not transfer it to the new passport. The ILR i received was on the basis of me getting married to a british national. (we have been divorced since 2018).
i never applied for Biometric residance card / permit.
but now i would like to apply for british citizenship.
I would like to know a few things please...

i was caught shoplifting in november 2009. i was given a caution by police for this.

and again in 22 jan 2017, the same sort of incident happened of shoplifting and the police was called again this time. police asked me if i had been in trouble with police in past. i told them YES, and told them about the first incident in 2009. but there wasnt anything in their record about 2009 incident. (may be because that was in a different county). so they didnt say anything about that. and this time they didnt issue any caution or anything else, no warning neither writing nor verbal, and they just said to me that do not do this again and let me go. i never received any paperwork/letter about it from neither police not the complainant.
so, do i have to declare this when i make application for BRP or citizenship? will that affect the decision? i have had an extended CRB DBS check done in 2019, and it came clean. there was nothing mentioned on it. can you please get back to me with the answers, i will very much appreciate that,

Hello

Simply put, you don't know. When it comes to citizenship, these guys have access to an awful lot of databases. Depending how thorough they are, they may or may not find these incidents.

If you declare these occurrences, I don't see you getting the citizenship. You have been caught 10 years apart committing the same offense. It suggests you are a repeat offender and God knows how many shoplifting you got away with during that decade. No authority would believe you if you claim that you tried twice only and got caught twice.

It's a known fact that most cases of shoplifting are not caught. So if they see these 2 cases, they may read it as you were quiet active in between and despite your experience, you got caught again.

This cannot compromise your ILR. But for the citizenship, it can cause issues.

Naturalization Application (Caught shoplifting)

Post by babbal_samrat » Sun Jul 11, 2021 10:11 am

Hi,
I am applying for a British citizenship (naturalization). I would like some advice and guidance on applying for british citizenship.
I have indian passport,
I have ILR in my indian passport. I have had ILR since Aug. 2008, my this passport expired in 2012, and i renewed my passport from Birmingham indian counsulate. but my ILR still remained in my old passport. i did not transfer it to the new passport. The ILR i received was on the basis of me getting married to a british national. (we have been divorced since 2018).
i never applied for Biometric residance card / permit.
but now i would like to apply for british citizenship. However I have some questions before I apply...
I have had a few incidents in past.....

1st incident: i was caught shoplifting in november 2009. i was given a caution by police for this.

2nd incident: on 2nd july 2013, i was stopped on motorway as i was driving over the speed limit, when i stopped, traffic police also found my car's two tyres were not upto the standards and i had to get my tyres changed right there before i was allowed to go. After a few months, I received a letter that i will have to go to the court and I was given 3 points and £225 fine. which i paid off same day. This showed up on my DVLA record for 3-4 years, and then it was cleared.
DO I HAVE TO DECLARE THIS WHEN MAKING APPLICATION FOR NATURALIZATION.

3rd incident: and again in 22 jan 2017, the same sort of shoplifting incident happened and the police was called again this time. I was given a community resolution this time. (community resolution is basically a resolution to provide an opportunity for the police to deal with appropriate low level offences and offenders without recourse to formal criminal justice sanctions. This could include a simple apology, an offer of compensation or a promise to clear up any graffiti or criminal damage.)

I requested my disclosure of data from local Police and PNC in Feb 2021, this disclosure came back with both of the shoplifting incident reports.

Should i declare this incident when i apply for my naturalization...

4th incident: I read somewhere that i even have to declare all the traffic / driving incidents including any fines too.
in Dec. 2019, i accidentally enetered in BUS lane while riding my motorbike. I was sent a fine (i think it was £35 / £40).
DO I HAVE TO DECLARE THIS WHEN MAKING APPLICATION FOR NATURALIZATION.

there are alot of experienced people here, Can someone please tell me from their experience that how likely is it that i will get success in my application of British citizenship.
can you please get back to me with the answers, i will very much appreciate that.
