I have been 5 years as students and then almost 5 years on tier 2. For the first 4 years everything was working perfectly as I was getting paid and I was paying tax. At the beginning of the fifth year (Last October) I regrettably moved to a new company where my troubles started and I was paid only for one month and then they suspended me. Even though they didn't fire and my visa is not cancelled, I have not been paid for almost seven months. I have started taking legal actions against them, but my concerns now: when I apply for the settlement on the 10 years basis (which is due in August), would this awkward situation with the company I am currently (technically) working for affect my legal stay counting.
In other word, would this time from November until I apply in August still be counted as legal stay in the country given that I am not fired but also not paid!!
