Need advice Please Help

Hi all, I desperately need some advice regarding my sister.

My sister got married to a green card holder in the US in 2001. They have two children, one born in 2001 and one in 2003. My sister had 10yr visitors visa at the time of marriage.

Her husband during this time has never bothered to apply for his citizenship which doesn't seem to to be helping matters, has she still has not acquired permanent residence. Their marriage is on the verge of breaking up.

She has not been able to work all this time and is unable to travel. They used an immigration lawyer and submitted some sort of application. She isn't very sure of what it is but nothing is happening.

Does anyone have any idea of what she could to go gain permanent resident without her husband's help? He doesn't seem to be interested in helping her gain residence.

You should find out what "sort of application" they submitted, and when. If she doesn't know, she should contact the lawyer and find out. If they filed I-130 (petition for alien relative), there is approximately a 4-5 year wait for spouses of LPRs.

Without her husband's help your sister has most likely no chances of gaining residence, unless she divorces him and marries someone else.
