Need Help - Going for hearing on 300910 for my in laws visit

Post by lapen123 » Mon Sep 20, 2010 11:37 pm

Hi All,

In laws visa refusal hearing is on 300910.
Visa officer has sent the court bundle emphasizing that sponsors documents are fine but appallent documents do not show that they will be able to accommodate in UK on their own.

Visa officer mentioned one thing in the bundle is that applicant circumstances are evaluated on their own. In other words even though sponsor can afford the stay but if applicant do not show that they can accomodate themselves without sponsors support in UK then they are not allowed to come to UK.

My question is in the hearing, will judge evaluate my In laws situation in isolation from my position?

My father in law income is not that much and he can not affort to accomodate himself here in UK. do we have any chance in the hearing. They are coming to visit us for the first time.
A response will be greatly appreciated. Thank you

if applicant do not show that they can accomodate themselves without sponsors support in UK then they are not allowed to come to UK.
''No recourse to public fund'', not a no recourse to sponsor's support. I dont think the above statement is correct. If a sponsor is providing accomodation and sufficient evidence is provided in the sponsor's documents, it should be ok.

Applicant needs to show proves of their own accomodation in cases where the applicant is not staying with a sponsor, then a hotel reservation for the period of stay might do just that.

I think you have a great chance of success in the appeal, if thats the case.
