Need old version PBSdependants - policy guidance

Hello all,

does someone have a copy of Old Points-based system dependants - policy guidance which was applicable as on 19th of Nov, 2008 (I believe the version is from Aug, 2008 but I am not 100% sure)

I know for fact they changed the guidance notes on/around 28th of Nov, 2008- so I just want the version applicable on 19th of Nov.

UK BA has rejected my application based on the latest version but I want them to refer them to old version based on which my application should be accepted.

Unfortunatley my PC crashed and I lost all the docs.

Can someone please post that or direct me to archive link?

It was tuned down as she was trying to switch in-country from WP to T1 Dependent. The don't allow that but in my case my dependent had previously entered in the UK as dependent and then as own WP holder. There was a clause in aug/sept 2008 guidance which allowed you to do the switch which has since been removed but was applicable when I applied. Now they are asking me to rewrite with ref to old guidance notes which I don't have.

SO need one- these are T1 (general) dependent guidance notes from aug/sept 2008.

As far as I remember it was never permissible to switch from WP to HSMP/T-1 dependent.

I agree with you all. However, there was a time when this was allowed, with intention or was a mistake - I don't know. Please note it was the clause which said your dependent can get the LTR with you:

1. If their current LTR is as your dependent
2. Or if they have been granted LTR in the past as your dependent. (which is my case)

Even I was surprised when I read that during that time (nov 2008). I spoke to their contact centre and we read the points together and was confirmed that yes, you can go ahead and apply (my dependent had entered the UK as "dependent" though she is on WP at the moment. Point 2 has since been removed from the guidance (sometime in end nov).I guess they must have realised their mistake after applications started coming in so removed.

After 6 months of "careful" review, they rejected this app (if point 2 wasn't their they would have rejected my dependent's app straightaway and not taking 6 months)

I'm directly in touch with caseworker and he says although you don't have right to appeal, but if I give them in writing with ref to this clause they will reconsider.

I unfortunately don't have the T1 - general- dependent guidance notes from Nov, 2008 which I need to approach UK BA. This was the the version released in Aug/Sept 2008.

If someone can help me find this will be really helpful.

Even if thats the case dont you think that rules as at the time of making an application will be applicable unless exempted specifically? I guess all those who applied after Dec 5, 2007 signed such an undertaking (main applicants).

Yes, that is what my point is. When I applied in-country switching from WP to dependent- it was allowed for a short period from aug- nov 2008. They changed this towards end of nov, just after I applied

The pbsdependantspolicy.pdf which i have was downloaded on 24 Jan 2009 and form itself show 110801 on the face

Already tried that. They had asked me to put that request in writing and we will address that as per our timeframes (read it as you will never get it)
