NEED URGENT HELP, please advice

Post by Kiran1 » Thu Jun 02, 2011 4:46 pm

I had to apply for a student visa extension. Extension requires some minimum points for it to be granted (30 points for confirmation of acceptance for studies plus 10 points for maintenance statements). For the latter, a student should have required funds of £800 per month for at least two months (therefore a total of £800 x 2 = £1600 for two months).

When I sent an application initially, the balance in the bank was three days short of the required 28 days. So the UKBA refused the application and the matter went to the Tribunal.

In the Tribunal, my application has been refused as I printed the Bank statement from the internet and as the ruling states 'the statement did not have bank stamp nor the signature of the bank official'.

I would be grateful if someone could advice under what grounds I can possibly appeal to the First-Tier Tribunal as I have been given just five days to appeal against the decision.

Any help in citing some past cases, various sections under the Immigration Act as well as the likely grounds of appeal would be greatly appreciated. I do not have the requisite funds to approach a law firm so would have to make an appeal on my own.

A special request to the Mods. of the forum especially SushdMehta, John and Vinny to please advice, if possible, as I am urgently looking for some sort of help given the paucity of time to appeal in this case....

Many Thanks.

You should have been very careful with that.. atleast 28 days of calendar month completely should have been in the record. so they have the right to refuse on basis of it
In the Tribunal, my application has been refused as I printed the Bank statement from the internet and as the ruling states 'the statement did not have bank stamp nor the signature of the bank official'.
"Go to the bank and get the statement.Make sure you get it STAMPED... without the stamps its not acceptable. as anyone can print it at home the way they want it. So stamps are more like a bit satisfaction for the ukba. and you yourself given them the chance for it to refuse your application"
I would be grateful if someone could advice under what grounds I can possibly appeal to the First-Tier Tribunal as I have been given just five days to appeal against the decision.
"As per my knowledge you dont need to hire any lawyer for it. Just provide them the required documents as per their requirement again. And i am sure now you can get the stamped bank statement as well of more than 28 days statement too"

.
Did the statements you provided at the tribunal show you had the money for 28 days? If so did the 28 day period end no more than a month before your application?

what statements did you provide with your original application - were they also internet ones, if so were the stamped? If they weren't stamped did the UKBA raise this in their refusal.
