New Overstayer rules

My husband has been in his own country for 4 years so when these laws come into effect does that mean he will have 6 years to do or will he have to start back at the 10? If its 10 how can they say that this is a fair law when other people before this law overstayed and got removed have been able to come back.The new rulings are not clear at all.

does the new overstayer law apply to failed asylum seekers who want to return home to apply . for example zimbabwe asylum seekers who are not currently being send to zimbabwe
