New rules for citizenship application

Dear friends,
I have recently read some updated news about the HSMP judicial review.

Here is my husband basic information;
--18th Nov 2003 Work permit granted letter
--23rd Feb 2006 HSMP Granted letter (However, LTR on passport was granted for 2 years on 28th April 2006)
--30th April 2008 Tier 1 Granted letter
--12th Feb 2009 Settlement granted (having completed five years continuous residence in a qualifying category)

and I would be grateful if you could help me with 2 questions.

1. Can my husband apply for one-off payment to cover the cost of Tier 1 extension which would otherwise not been required if he could apply ILR in Nov 2007?
This is a bit tricky one. My husband got 2 years HSMP on his passport initially though he received HSMP approval letter before 3 April 2006.
I am not sure whether the tier 1 extension will be counted as second extension or not.

2.If we can not apply for one-off payment, where can we get a confirmation letter form the home office in order to apply Citizenship?

Yes, it will be counted as long as you have applied and paid for it to qualify for settlement. Also, for the fact that HO actaully approved your extension make it more apparent that you qualify to claim it.

Hi iyanu,
Many thanks for the reply.
I have looked at the HO website again, and it says... You will be able to apply for a one-off payment to cover the cost of your second extension application,... as i mentioned in my previous post, Tier 1 extension is the first extension after initial HSMP.
Do you think we can still ask for one-off payment?

Yes, he qualifies to claim back the money. This is the breakdown analysis I did to arrive at that conclusion:

Nov 2003- Feb 2006 = 2yrs, 3month


April 2006 - April 2008 = 2yrs

Total = 4yrs, 3 month.


At this stage going by the JR ruling he had spent more than 4 yrs in the UK, hence qualified for ILR as at Feb 2008.

He now extended his stay for 5yr ILR which he was granted in April 30, 2008. This becomes unnecessary because the JR ruling has nulified that extension anyway so he is entitled to claim back that money for that.

Tell him to fill the form and get his refund while you guys apply for your naturalization.
