NHS surcharge refund after ILR

Post by JS28 » Tue Mar 31, 2015 10:41 am

Hi

Is the NHS surcharge refundable when you switch from Tier 2 to ILR?

I will be applying to extend my tier 2 general visa for 3 years in March 2016 and will have to pay £600 for NHS surcharge. I will complete my 10 years in August 2016. I can apply for my ILR on 26th of September 2016.

Can I ask for the refund when I switch since I will be considered as permanent resident if I get my ILR?

Would you ask your car insurance company for a refund if you'd had no accidents?

I believe the OP is saying he will be paying for 3 years surcharge, but will only be liable for 6 months. In which case if compared with a car insurance there would be a rebate (i.e if no longer in possession of the vehicle). Knowing the UKVI, they probably haven't allowed for that yet. :?

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Yeh i dont think it's fair that I have to pay 3 year's worth of NHS Surcharge when Im only going to be a migrant for 6 months.

As a non-eu tier 2 applicant, i'm already paying more than EU citizens most (not all) of who are here to get the benefits. I pay £700/month on tax and NI.

A simpler option would be to apply for a 1 year extension. Assuming you will go with ILR processing in Sep/Oct 2016, it should be fine. You will only need to pay for 1 year surcharge. I've not read anything about refunds yet in any official document.
