HI everybody

I need some advice so that can apply for PR. i will realy appreciate if u can give ur comments please.

I got married to portual girl in aug2003 and got 5 yr resident permit from feb2004-feb2009 on a paper and got my passport stamped in april2004 and visa valid till feb2009.

I have been working full time,paying taxes as she didnt wanted to work so i was supporting her and have been living together through out. but JAN2008 she changed her attitude and got seperated from me and was in n out from my life as she had a new fling too.

so DEC2008 we decided to go differnt paths and i took it upon me to file for divorce as she dont want to waste money.

She is not gonna help me wth her documents like Passport or ID card etc. BUt i do have our Joint bank statement,utility bills, councils tax bill,phone bill on our both name. i dont have her P60 as SHE WAS NOT WORKING ALL THAT TIME.

My RC(Resident Card) is due to finish in feb 2009 so please advice me
i will be very grateful to u all

DO NOT divorce until you convince yor wife to cooperate to get your PR or you risk what I am experiencing in worst as you do not have any proof of her exercising treaty right.

thanx for r reply.but i have done all i can do but she is not ready to cooperate at all as she is going out with sum1 and i think undr his influnce she is doing this. i have no other option. just to let u know i do have her RC (the blue one) if that is of any help

the truth is no one is sure, we all thot the eea laws were clear on divorce but a few people that have applied on grounds of divorce have been refused without their ex's id or passport. we are all waitring for their cases to go on appeal or judicial review to know the final verdict. in the meantime you can apply give them what you have and wait for them to start asking for more docs. maybe by then the rules will be clearer.

thenx for ur reply i have send my eea4+council tax bill+gas bill+electricity bill etc with a covering letter explaining my situation(about the divorce as i have nt received any thing abt my divorce ).so lets c wot happens now

The blue registeration certificate

Cheers on keeping that one, atleast you have something proving that she had presented her documents to home office previously and that the home office had only issued that blue registeration certifcate after verifying everything, & if you are presenting that, I think its atleast better than not having anything. Hug that certificate before going to bed everyday, it might save you.

I am going to apply my divorce soon, and shouldn't be too long and I will be in your place.

thanx for ur reply and gud luck to u tooo. but my only concern at the moment is i have not rved my decree nissi yet so dont know who long ts gona take to get that....... so im bit worried. I called HO yestrday they told me that they have received my application but didnt tell me if i have been allocated the case worker. so good luck to me.
