Hi All,

I desperately need your advice.

I recently submitted my application for permanent residency - 23rd February 2015. I'm a non EEA spouse and my EEA family residence permit expired on the 5/03/15. My husband a Portuguese National obtained his document certifying permanent residency in August 2014. I received a certificate of application from the Home office stating that I have not submitted sufficient evidence showing that my sponsor has been exercising treaty rights ?? and therefore the Home Office cannot confirm my right to work until a decision is made- which could take up to 6 months. I have sent ample evidence of my 5 year residency - 2 X C5 envelopes. The only thing that is missing is his payslips from Aug2014 to current as I didn't think to include it. I didn't have many documents of both our names on them during the 5 year period except for council tax, tenancy agreements and joint bank accounts.

Questions:
1. Can I still work (I am employed) or is this illegal ?
2. Can they refuse my application?
3.What EU rights do I have? My husband is in full time employment and my son, also a EU citizen was born in the UK but not a UK citizen
4. Am I facing a laborious appeal/ court / deportation ?
