Non EU spouse coming to Ireland.

Post by wannago » Wed Feb 26, 2014 7:20 pm

Hi all, first of all such a great board with a lot of information on it,it`s been really helpful.
Just a couple of quick questions.I`m a British citizen, born in Northern Ireland, but I`ve never had an Irish passport.
At the minute I`m living in Brazil with my Brazilian wife and our two kids who were born here.
Is it possible for us to live in the ROI for 6 months and then go to the UK to live using SS?
Also do we just turn up at Dublin airport with our passports and wedding cert.?
My wife was refused entry to the ROI before, but we weren`t married then. The IO told us he thought we would go to NI so he couldn`t allow my then girl friend to enter. So would this have any affect on us when we arrive at Dublin airport.
Many thanks in advance.

in short yes. all is possible.

You must apply to the embassy in Brazil, who basically issue a special travel visa for those wishing to exercise eu treaty rights.

You must explain this to them that you wish to exercise your EU rights pursuant to directive 2004/38ec. and you will be required to send in copy of your passport, wife's original passport and copy of marriage cert. She should be issued a visa within 4 weeks.

There is a special SS website that you can google, something like surindersingh.com which has the template letters to send to the embassies.

you move then must move and work in ireland, or be residing with sufficient resources, your looking for about 3-6 months MINIMUM worth of payslips to obtain entry with your spouse back into the UK.

Thanks for the reply, but I didn`t think that my wife would need to apply here for a visa as she doesn`t require a visa to travel to Ireland.
