non-EU spouse EU Treaty Rights -Documentation needed at port

Post by NadineK » Fri Mar 18, 2016 11:03 am

Hi there,

I'm a South African citizen and my husband has dual citizenship (Souhth African/Austrian). My son also has the same dual citizenship.

My husband has accepted a job offer in Dublin and will be moving end of April. My son and I will only be joining end of May/June.

As a South African I'm visa exempt upon entering Ireland, but I will be entering Ireland to permanently reside.

I've contacted the Immigration Council of Ireland and was advised that a 90 day visa will be granted at the port and I should have the following documentation available to prove that my EU spouse is living in Ireland and I have the right to enter and stay under the EU Treaty rights on free movement for qualifying non-EU family members:

· Evidence of identity of the EU Citizen (Copy of your husband passport)

· Evidence of relationship with the EU citizen (marriage certificate)

· Evidence of current activities of the EU citizen in the State

· Current letter from employer setting out terms and conditions of employment OR signed contract of employment and Two recent payslips(this will be if the application is based on him being an employee)

· Evidence of residence of applicant and EU citizen in the State

· If renting, copies of the following documents should be provided:

· Letter from landlord/agency or tenancy agreement letters of Registration of Tenancy from the Private Residential Tenancies Board and Utility bills for the EU citizen

Naturally, entering Ireland without my EU spouse, and travelling with a 4 year old is stressful and I want to make sure that I have the correct information to be granted permission to enter.

Has anyone had any experience immigrating to Ireland under the same conditions and what was the process? Should these documents be sufficient to gain entry?

Thank you!
Nadine
