Non-Eu Spouse Visa

Post by chursy » Sun Aug 08, 2010 6:28 pm

Hi there,

I am a British National, naturalized in the UK in 2006 and currently based in the Republic of Ireland for the past three year ( moved due to employment). Prior to this i was based in UK for over 10 years.

I am married and my spouse is Non- EU national staying with me in dublin on a EEA resident Visa. Most of the guidance around the residence visa, is based on the fact that the EU national ( Sponsor) is in the UK and is sponsoring the spouse. My circumstances are slightly different

We plan to move to UK around May 2011 but i would like to get the immigration issues resolved before hand. Hence i have few questions regarding this matter below:-

1) What visa do i need to apply for my wife, the EEA resident Visa or a visit visa application needs to be made first, following with the EEA visa once in UK?

2) If i dont have a job secured in the UK,as far as i can show that i have sufficient funds and a family owned property to stay in is this going to be a problem? Would evidence of my existing job in dublin be required or suffice?

3) My wife is currently expecting, will the child be a british national? Can i apply for the passport to the british embassy in ireland?

4) My main concern is that can i apply for a spouse visa for my wife and child as we intend to move to UK before hand or do i need to apply for her once i am settled in the UK?

I would be deeply obliged if someone can please help in responding to the above questions.
