NOW WHAT? how much time next step will give me?

Post by malik131 » Fri Feb 07, 2014 3:59 am

came in UK 4 june 2004
spend all my time legal on student visa. on 30 DEC 2013 i have applied for FLR(FM) because i can not apply for any further student visa. on 12 Feb received BioM letter. on 28 jan i completed the BioM as i was trying ti linger the visa process BUT guess with UKBA is more cleaver then me within 2 working days they have refused it and send it back to me with right of appeal til 17FEB and also mentioning section 47 as well ( guys believe me the wording is not anyway less then threatening)

i am surprised that how quick the send it back although my application was not usual one. with very rare life threatening medical condition and one life threatening social condition both under artical 3 and 8, was so easy for them to decide it over the weekend. :!: :?
My 10 years will be completed in 4 June this year and now here is the main part of the story. where i need your help Questions yes Questions
1. if submit my appeal on 15-17 of this month so what is the currant time they are taking for hearing?
2. in my refusal they said " beacuse i have not completed 20 yeas of law full residence so are not meeting the requirement. Now what is this? i have not applied under illegal recidens nor i made any ground on that. so where did this 20 came from?
3. while i will wait for hearing date will that 28 days early then 10 years rule will apply for my case as well or i can not change my circumstances until 4 june?

so guys its all yours and will wait for you expert and humble replies
thanx in advance :D

Student visa never was a path to residency.

It seems a rip off that they tell you to go for BRP then a few days later send refusal. They must know they are going to refuse but just suck more money out of you before you go.
Its happened to my gf twice now, send for BRP then refused.

Nothing to worry about mate. Appeals are currently being listed for up to 6 months! So your appeal date WILL definitely be sometime around August/ September 2014 and you will have clocked your 10 years :D  .. Go ahead and submit your appeal in time, when you receive your hearing date you can add additional grounds to your appeal (10years lawful residence)
IMpossible is 2 letters to long!
