Hi
I am overseas student, leaving with my kid aged 4.5, studing here in school as well, and my wife is also with me. I like to stay in UK permanently in future.
I came here to study Law, but as soon I understood it is better to study Computing, as there are some new law comming. However, can you please advise me how long I need to saty in Uk as a student / or other status to qualify me to apply for Nationalization / or to get unlimited visa.

NO. I came to UK last Septembet '99 and my wife and kid entered in Uk as dependent Jan 2000.

Hi,

well you need at least 10 years stayin in the UK as student to apply for ULR (unlimited leave to remain) or 4 years on a work permit base. At this moment there are some regulations about shortage in the IT field that make easier (in theory) apply for a work permit.

Its actually ILR -- Indefinite Leave to Remain, not ULR. If you fall into one of the shortage occupations as listed on www.workpermit.gov.uk then your employer won't have to run job ads, its MUCH easier that way.

Thanks to u all.

I heard from one of my friend that anyone who is leaving in UK as a student status with his family for 7 years, he can appeal for Unlimited Visa. Is it true? Please let me know.

Hi

If you have lawfully been in the UK for ten years in any lawful status you will probably be in a position to apply for indefinite leave to remain under a concession outside the immigration rules. For example, you may be a student who can show ten years in the UK in student status, or can show ten years in the UK in a combination of student status and some other status.

There is also a concession whereby a British Overseas Citizen (not the same as a British Citizen) may gain indefinite leave to remain if he/she has been in the UK for seven year. This is also a concession outside the immigration rules.

Once you are granted indefinite leave to remain you will have to wait a further year before applying for naturalization (UK citizenship). Simplifying the requirements to a certain extent when you apply you would have to show that you have spent most of your time in the UK in the preceding five years before you apply.

Thanks for your reply.

Will appreciate if you please confirm my understanding.

I have been in UK as a full time student for last 3 years along with my wife and a kid , who is also studing here.

1. If I stay here for next 4 years as a student, I can apply for ILR status.

2. Or If I change my status as WP holder after 4 year time I will be able to apply for ILR.

**** Can I open a business office (IT based), and ask for WP here as well, please advice.


Please suggest me which will be the best way to get ILR status, as I really need to stay here.
