Hi,
Does anyone have any experience or advice on this...

My boyfriend is American (we're gay) and he wants to come to live with me. I understand that he can come over here for 2 years, then if we can still be together and can support ourselves he can stay? Is it as easy as that? What are the chances of him being able to stay after the 2 years are up?

The alternative is for me to move there, but it seems too complex and I dont have enough qualifications. He does not have any - does that effect him moving here?

If anyone can help me please please do, this is so frustrating!

Yes he can come overhere and will get a visa under the unmarried partner rule. However, the catch is, in order to prove the seriousness of your relationship you must have lived together for 2 years before applying for the visa. For times that you have spent apart you should have good reasons.

Is it possible to get a work permit under the unmarried partner scheme if you aren't gay? I am a US graduate student with a student visa studying in the UK and my boyfriend of 6 years is hoping to be able to come and work while I am here.

Nope. You need to have (legal) reasons that keep you from getting married, i.e. one partner is still married and can't get a divorce for some reason. Not getting married by choice doesn't qualify.

Unmarried Partner status was previously a concession outside the rules but pressure from various organisations (stonewall etc) have seen it incorporated into the Immigration Rules. Key criteria is:

1. Partners are unmarried because they have NO CHOICE - This practically limits it to SAME SEX relations or those who are already married (people waiting to divorce or those who cannot divorce for religious reasons).

2. Partners have been in a relationship similar to marriage (cohabitation, shared commitments etc) for 2 years prior to the application.

3. If the applicant intends to eventually settle in the UK under this category the UK based partner must have settled status - UK citizen, UK permanent resident or EEA/EU national. For EU/EEA nationals UK legislation is used rather than Community law which recognises Spouse and dependent children as family members for rights of residence.

You must then meet the conditions of having appropriate accomodation and enough money to support yourself and partner without recourse to public funds. The partner can work without the need for a Work Permit.

After 2 years on Unmarried Partner status the non settled partner can apply for Indefinite Leave To Remain.
