Charlotte P Junior Member Member # 2266 | Posted February 28, 2003 12:27 PM My Husband got his Visa today, but apparently they've given him entry clearance for a year and we have to get a work permit from the Home Office here. I thought if he got a settlement for spouse visa he doesn't need a work permit?! This doesn't make sense to me, anyone shed any light?! |
Elisa Member Member # 2487 | Posted February 28, 2003 03:35 PM I'm guessing the spouse visa just means he can come into the country to be with you and that if he wants to work then he is still subject to the same laws as every other non-national which is in order to be employed he needs to have the company of employment obtain a Work Permit. Makes sense to me. Why don't you call them and ask them why? If they printed that on his visa then either it's true or they've made an error, only they can answer that question for you. Word of advice to you, most of us that post here are not anywhere near to being experts on immigration, unless someone from workpermit.com actually posts here I'd take any information with a grain of salt. |
Jaz Junior Member Member # 2748 | Posted February 28, 2003 03:57 PM Spouse visa is intially granted for a period of one year. At the end of first year, you should apply for indefinate leave (ILR). You don't require a separate work permit with a spouse visa. The spouse can take up any legal work in UK. Rgds |
Elisa Member Member # 2487 | Posted February 28, 2003 04:04 PM It might also make a difference if he's a highly skilled professional or not? For example it could be that most spouse visas are granted to women who are usually home makers or working in potentially low skilled jobs. If he's say an IT professional that might make a difference. Each situation is individual and in this case we don't know any details about the husband so it's possible this is a special case somehow or as I said it could very well be an error. Either way only HO can answer the question and rectify it. We also dont' know is the poster is just assuming that the husband needs a work permit or if the HO is actually saying he does. If HO is saying he does then only by contacting them for verification can the situation be assessed. |
