Hi Room,
I just finished my MBA and wish to apply for HSMP. However, I have no earnings for the past 12 months (since I was a full time student). My earnings prior to going into full-time education meet the HSMP criteria.

Quick question: Can I use my earnings .before I went to school OR is the HSMP team very tough on their "earnings in the 12 months immediately prior to application" stance?

Any comments/help appreciated.

I don't think so. They ask for a proof of earnings in last 12 months.

Best to ask the HSMP people at Workpermits UK directly - you can email them and they tend to answer queries personally in good detail. I would like to think they will judge you on your 12 months income prior to study but who knows - best to ask them directly.

I believe you can as long as you meet the criteria and you interupted work for only the time you studied for your MBA. I'm pretty sure I read on this site months ago that you can/

Ok. So I sent the HSMP team an email and had no reply for a bit. Then my patience wore off and I decided to give them a call. Here's the scoop:
1. Since I was in full time education the last 12 months, I can use my earnings from the 12 months prior to that
2. However, I had been given a visitor visa extension to wait for my graduation. The HSMP team was pretty firm in saying that I can not apply for HSMP on a visitor visa but would have to go home and apply at the British Consulate there.

I am thinking about switching back to student status (enrolling for a short course) and immediately applying for HSMP.

Any chance this could get me in trouble?null

HSMP issue is 2 step as you have stated:

1. Get HSMP approved.
2. Get your immigration status changed to HSMP.

HSMP team at Work Permits UK are correct in that you cannot change in country from visitor to HSMP. Your plan to change to student status depends on if you are a visa or non visa national. What is your nationality? If you are a non visa national and can change to student then you must get that status first then apply to change to HSMP status. Note to change from visitor to student status the course must be a full time course of at least 15hours of daytime study in a single subject or closely related subjects at a single institution (note the institution may have multiple sites). If you need to expedite the relevant immigration changes you need to go in person to the Public Enquiry Office in Croydon fairly early. You may get same day change of status.
