dear friends
if anybody got experience the following please help me

if the person is working in uk, before the visa expires can he change the status from workpermit to student visa without leaving to home country?or

for that student visa
he has to go back and get stamped there?

and the entry clerance visa has expired in case, shall the person can stay as per workpermit ( from the date of entry 18 months)

1. Under the Immigration Rules only persons classed as Non Visa Nationals (NVN's) can change status 'in country'. Persons classed as Visa Nationals(VN's) must apply overseas for a new visa to reflect their new requested immigration status though they may change status in the UK in limited categories (e.g. spouse of a settled person)which do not apply to students. The visa application must be made at the British Embassy/High Commission serving the persons country of nationality or legal long term residence. However the Home Office has power to consider an application outside the rules and may accept an application for a change of status from WP to student from VN's. I would recommend that you demonstrate significant funds for this type of 'discretionary application' and that you go in person to a Public Enquiry Office.

2. I am not sure I understand your 2nd Q. However a WP is no longer valid after you leave your employer inclusive of any notice period. Consequently the WP Visa/Stamp in your ppt is no longer valid even if it has not expired. Even if it were valid you cannot use it to study as this is not what it was issued for - each visa is issued with its own conditions. You would be expected to depart the UK within 28 days of your employment ending, get a new WP or change status which as described above is not so straightforward for some.

Check with the UK Embassy in France whether they are willing to process an entry clearance application for you. It is much cheaper to pay for 2 way Eurostar tickets + visa fees than go in perosn to Croydon (or any other IND PEO).

iamvery happy to receive the message from you.after your message i had called home office and findout the possibility to change the status hear.same they had explained me.so iam going to india immedietly now. can you give some assistance, what the documents i have to take withme

You will find the relevant information from the Consular Section of the British High Commission in New Delhi.

Kay,
Honestly your patience is to be admired. How can such moronic questions be asked on this board. Geez, I wish someone asked me that question and I'd probably say 'Get a year 1900 remington typewriter and type'. The HSMP team doesn't like hand written or electronic typewritten applications. And even computer printed applications are banned in their (HSMP) domain. Watch out lads......

Hello! In light of the recent changes, I was hoping one of you would have the answer to the folloiwng question:

What if I decide to pursue a master's degree after 2 years of being on HSMP"? Would I need to revert to a student visa? What if I study part-time and work during the rest of the time (besides sleeping and other things of course :-))

If you are to study full time then you need to get a student visa. If you will study part time i.e. as in when you have some free time from your HSMP designated occupation then you can stay on HSMP status ---after all the UK is pretty keen on getting us oldies to commit to lifelong learning eh BTW if you do study full time yet remain on HSMP (whih I am sure you won't ) you will get caught out at ILR application stage. Happy Studying

Thank you, Kalayami! But they should be encouraging life-long learning! Especially all those kids in the under-28 category, many of them do not have but want to have master's degrees!
