That letter should be fine, when accompanied by your payslips and current account statements. The form says "documents from the employer confirming that your employment is continuing." It doesn't have to be a letter addressed to the Home office.

The Home Office is not likely to contact the employer given the other evidence you provided and the fact that your WP was just renewed. Even if they do, what are your employer going to say, that you are not a permanent employee? That would be a lie contradicting their signed letter and the WP application. They could be prosecuted for that. If they tried to fire you after being contacted by the Home Office you would have the basis for a good lawsuit. Don't worry!

If you happen to have a copy of your latest work permit application, it would be good to have but not essential.

Be sure to also bring your payslips, especially the last 3 months, your corresponding bank statements (which match the payslips) and the letter you mentioned. If you provide them with all that information, they should approve on the spot without asking any questions.

You're welcome. BTW, how long do you have to wait for an appointment? Be sure to tell us how it went. Also, I'm sure it will be fun to see the look on your employer's face when you tell them you've got ILR!

In the very unlikely event that IND ask for more documentation or propose to call your employer, DO NOT withdraw the application. Besides losing £250, you might make them wonder why you are withdrawing. Instead, explain the situation saying that your employer has declined to sponsor you for ILR because they are afraid you might leave. (This is probably not too uncommon a situation for them.) Explain that the credit reference letter was all you could get out of them. Point out that their recent application for the 3-year renewal of your WP is proof of their intention to keep you as an employee. If they need to do any checking, they should do so with Workpermits UK, not your employer.

Also, if you have an employee identification badge or entry card, bring it with you to show you are an active employee. Your bank balance should also give them assurance that you will not need public funds anytime soon. I really don't think they will ask any questions making any of this this necessary, but it's good to be prepared.

Thank Joseph,

I went to Croydon.

Reached around 7.15 am. Got token at 9.00 am.
Interview / document submission at 10.30 am.
Got documents back at 12.30 pm.

No questions asked during interview. In fact did not say a single word from entry to exit in Lunar House.

Docs - apart frm employer letter other docs were not even glanced - i took some payslips and bank stts, work permits etc. I had one dependent stamping as well.

Why do they need the workpermits / work permit extension letters? The passport stamps should be enough to prove that. Isn't it ?

You must be right. They checked all the stamps but in the initial document check (before payment) they also saw all the work permit and extension letters.

What's the impact on my 3 year WP ? In the hindsight I feel that workpermit is better )if you want to remain with the same employer) because you can come / go any time as long as it valid. In case of ILR it becomes invalid once I move out of the UK on non-temporary reasons.

Your WP whilst technically valid is actually no longer relevant. The previous accompanying Leave To Remain stamp is also no longer valid because the Indefinite Leave To Remain status you have acquired supercedes it - the IO at Croydon may have put a note to this effect in your ppt. Actually does the new ILR vignette have printed text and not ink? Look at it this way - your employer no longer has the ability to get rid off you by no longer renewing your WP. They must now use other means such as redundancy etc for which there are employment laws in place they must follow.

You are also free to live and work in the UK without any restrictions so have become very marketable in the labour market. Your ILR is safe as long as you do not leave the UK for more than two years continuously. Note that leaving the UK for close to 2 years then re-entering to preserve ILR status is likely to get caught out by Immigration Officers at a Port of Entry or at naturalisation stage. In fact anectodal evidence shows that ILR holders really get scrutinised when entering the UK relative to say WP holders. You can also be stripped off ILR if you commit certain heinous crimes such as murder etc. Enjoy your new found freedom that ILR gives you and don't sweat about your employer - as the saying goes he/she can't do 'Jack'

There is no note on the passport - atleast I cannot find it - where would it be ?

The new vignette stamp has printed text GIVEN LEAVE TO REMAIN IN THE UNITED KINGDOM FOR AN INDEFINITE PERIOD.

Especially given your description of your current employer, you are much better off with ILR. Now you can either stay without fear, or leave for a new job on your own terms.

In a year's time, if you wish, you can apply for naturalisation and not have to worry about immigration control either.

Just out of interest - what questions does the IO ask at the port of entry to a person holding ILR ? And does the person getting ILR as a dependent have also to comply with the 2 year condition.
