Dear Forum,

We have recently been blessed with a baby daughter and since I am still on a Work Permit, she has been given an Indian Passport issued in London.

Now comes an issue of her visa (dependant):

1. Is there any time limit before which we must get her the visa?

2. We are planning to go to India in two weeks time, is it possible to get the visa at the Heathrow airport on arrival from India? Would that be charged (with the introduction of recent charges by home office)

3. What do you suggest should be the best way to get her the visa.

Any help would be greatly appreciated.

A friend of mine had similar problem two years ago. His child was born in UK, given a polish passport then they went to Holland for a holiday.

When they arrived back at heathrow, they were told their son illegally stayed in UK
without a visa. They were stranded at the airport for many hours.

Finally his passport was stamped but the experience was not good.

As a polish passport holder the child didn't need a visa to come to UK and the only problem was that he stayed in UK without a visa before leaving the country.

You case may be even complicated because India passport holders need a visa to come to UK.

You can get your child Indian passport and get LTR stamped before you leave the UK. There should be no timelimit as I know a few examples where they had to rush to their native countries (incl. India and Pakistan) in case of emergency situations and got the passport and LTR for their children a week before they departed -much after thei birth. But in any case, in your situation you need to do these now as you plan to travel. Yes, there is charge for this. Don't think you can do anything at the airport about this on arrival.

In that case, does anybody what are the charges? Has there been any reduction is congestion in Home Office Croydon? Last time I went there, it was a horrible experience.

Anybody having recent experience with home office croydon?

You should get your clild's passport stamped with Further Leave to Remain BEFORE you leave the UK.

I think you will be able to use Form FLR(WPH) which is free. Otherwise, you may have to use FLR(O) which has a fee. You should be able to get it sorted out on the same day at the Croydon PEO. The application forms are downloadable under:

You should bring with you all of your passports, photos, your WP, and your child's British Birth Certificate.

Croydon is never easy, but I understand it has gotten better over the last few months because of the fees that are charged for most applications. They say that if you go in the late morning, the wait is not so bad.

Joseph 01,

1. You are on the right track in terms of the supporting documents to be submitted i.e ppts, photos, WP and birth cert.

2. However the form to use in this case is FLR (O) not FLR (WPH) which can only be used if an applicant was admitted to the UK for 6 months or less on arrival but holds a work permit valid for more than 6 months. You will have to pay a fee of GBP 155 for a postal application or a GBP 250 for an in person application at one of the enquiry offices.

3. Note that a child born in the UK whose parents are neither settled or British citizens (and therefore the child is not a British Citizen) does not need formal leave to remain in the UK. The second post is somewhat concerning as to the behaviour of the IO's on the matter of over staying which only applies wher one must hold leave to remain. However if the child departs the UK he/she would require leave to enter.

4. A child in 3 is entitled to register as a British citizen if his/her parents obtain ILR (if its the father then he must be married to the mother). The child can also be registered as a BC if he/she spends the 1st 10yrs of their life in the UK with absences of no more than 90 days in that period.

5. The queues at Croydon are not as bad as they used to be and going there in the afternoon is less hastle.

You can also go to regional offices in Birmingham, Liverpool, Glassgow if that is convenient for you and you get appointment. I remember coupld of guys going to Birmingham PEO for FLR for their kids born here.
