Hi All,

Great news!

I had an appointment with one of the PEO's today and got my ILR approved and my passport stamped with the new vigenette ILR sticker.

I was also given a 2 page document (with IND seal) explaining that I have been granted the ILR and explaining the details of how the ILR works.

The documents I was asked in the interview counter was:-

1. My Company incorporation document, share capital document, my recent accountant's report.
2. Latest Inland Revenue and NI payment details (both as an employer and as an employee - because I am self-employed)
3. My Job description and day-to-day duties document
4. Latest Business bank statements - to prove my software development income and my salary payments
5. My last 12 months personal bank statements (HSMP period) to show my salary payments coming from my company/business bank acount.
6. All of my Work Permit originals since my first arrival in the UK and my recent HSMP approval letters.
7. My business contracts and any recorded time sheets that I have submitted to my customers for billing
8. My recent Invoices that I have raised on my customers
9. My self-employment registration details with Inland Revenue

I submitted all the above details and I was asked to wait for a while.

I was called in about 30 minutes and was explained that I had been granted my Indefenite Leave to Remain and the case worker handed to me my ILR stamped passport! ;-)

It all went very smoothly... because this time I had take all possible documents with me... especially the ones relating to business registration, Income tax, Corporate Tax and NI.

I can tell you that they have a very good system of information database... they were able to verify everything that I had put down in my cover letter to the application... by-the-way... I had prepared a very nice and brief cover latter explaning my the entire details of my immigration history right from the day I entered UK the first time and all the details about changing over to HSMP. ;-)

Thanks to everybody in the board who have been very helpful/informative and morally supportive to me (during my HSMP renewal times, especially ;-))

Congrats - with your documents it was a no brainer for them to approve it.

Edit: pardon personal question but did you make much money in HSMP period? Ballpark figure would have been great, ie: 15-25k, 25-35k, 35k+.

Also did you earn money all the time during HSMP period?

Congratulations, and thanks for the detailed information! It looks like you had a more "relaxed" experience by booking an appointment at one of the remote PEOs. Would you recommend that vs going to Croydon?

With the job market picking up, I am hopeful to do the same in the next few months...

Yes! I would defenitely recommend anybody to take an appointment with any of those 3 PEOs while applying for ILR. Its much realaxed environment!

I join Joseph, Dip et al in congratulating you on your attainment of ILR. Its certainly been worthwhile learning from your experience (definitive material for future case law) and admiring your ability to stick it out given the scenario leading to HSMP renewal and the fact that you almost gave it all up. Next step naturalisation then hopefully never have to deal with Croydon et al again

Hi User!

Congrats re your successful ILR application!

Question: do they really asked for all that documents or you just volunteered? The list is much longer than the one for an ILR application based on WP...

I've got my HSMP extented in April 2003. I was self-employed during the first year and was able to demonstrate some income. However, I haven't earned much since then. And that worries me with respect to my hypothetical application for ILR this September (I was on WP prior to HSMP). If they really require a detailed account of economic activity throughout the WHOLE period of HSMP I might be in trouble. Does anybody have a similar situation and/or experience?

User, may I also ask you a couple of technical questions? Why would they need your self-employment registration if you used a limited company for your trade? Why would they need your invoices/timesheets if you had a (presumably all-embracing) accountant's report?

I guess they may not need all the documentation I submitted, from every other WP->HSMP->ILR applicant.
If you go through my earlier threads, you will note that the HSMP team did not have the requisite expertise/information to process my self-employment aspects for my recent HSMP renewal.
I had to send so much information over a period of 3 months to establish my eligibility for a HSMP renewal.
I guess the ILR case worker was able to see this in his computer and hence asked for all these information once again.

I never volunteer any information (it only distracts the case worker's attention) - I leave it to the case worker to ask me for information that he/she may need from me to process my applciation.
And I did just that!

Oldboy,

I am in a very similar situation. Assuming you got a 3 year extension from April 2003 and you can apply for ILR from September 2004, the important thing is that you can show stable ongoing income.

In the case of employment, you should be hired as a employee and show the contract or offer letter and a few payslips (i.e. preferably showing that you are past the 90 day probationary period). A letter from the employer could help, but it's not necessary. The period of unemployment before you were hired shouldn't count against you.

For self employment, the fact that you don't have much recent income may be a little more sensitive. In that case, having at the time you apply for ILR a few months of historical billings and an ongoing contract with a client lasting a number of months in the future would be helpful. Naturally, the documentation for self employment needs to be more extensive.

Basically the rules in either case state that you must be economically active at the time of getting ILR. Since you have a 3-year extension, you have plenty of time to do this after September; the most convincing way to show this would be (in my opinion) to show about 3 months of historical cash earnings with at least 3 months of expected future earnings.
