Hi not sure where to start so thought this forum looked promising.
I'm in UK boyfriend has been refused entry from tonga (overstayed the last time he was here) is hoping to come back to play in a sporting event in June. Any ideas how we can ensure he comes back in June and what the options are for the future. He has already tried getting a club to bring him back to play for this year.

Your boyfriend has to improve on his 'returnability' capability.....unfortunately as you said he has overstayed before....therefore

In other words if he had a long term job to which to return in Tonga, then this could be a very convincing case....

....the easiest and guarranteed entry would be if you got Married and/or arranged to get married...

...it may look a drastic move but is bound to overcome this problem...if you really really really love him...then you would do the needful

Entry into the U.K. is broadly in two categories.

1. Those leading to settlement (CLS). This can be family based e.g. marriage to a UK national or employment e.g. Work Permit or HSMP.

2. Those of a temporary nature e.g. visitor or student notwithstanding that the course can be of several years because there is an expectation/ requirement that once you are done you go back home.

Unless your boyfriend is coming to the UK in a CLS then his chances of getting a visa are next to none. Its tough enough when you have not violated UK immigration laws by acts such as overstaying to get a temp stay visa. Unless he has strong ties to his country i.e. good job, family, property etc then you are looking at visiting him not the other way. The suggestion by chess of marriage is one option but would depend on your UK status i.e. are you a citizen, permanent resident etc. Employment authorisation for him depends on his academic qualifications and work experience although there are sports related WP's especially for the football (soccer), rugby and cricket sectors. Note that this often requires the person to be a professional player representing their country at international level.

There are some legal alternatives, but it would be helpful if you provided some more data as follows:

1). How old is the boyfried, more than 30 or less than 30?.

2). Has he got secure employment in Tonga?.

3). Is the forthcoming 'sporting' event in June recogonised in the UK sports Calendar (as an international event)

ECO's and IO's should not treat previous 'overstaying' in a punitive way.....

...so, it is still possible that your boyfriend can get a visitors VISA so long as the circumstances are strong enough to ensure 'returnablity' to Tonga.

It would also be helpful, if his visa application for the sporting event is handled/applied for in a 'group' i.e (Team application rather than on an individual basis).

Thanx guys
He is 28yrs old and has played rugby for his country so this time it is the international rugby7's. He was allowed into NZ and Hong Kong but the USA didn't allow him. He doesn't have any sort of work experience always just played rugby so no job to go back to. I think the application is a team one so fingers crossed. Not sure where to go from here. Being honest before he had to go home our relationship was new and it wasn't too serious so although I'd jump at the prospect of marrying him I don't know what the reality is.
Again thanx I won't know what to do for him as the language barrier doesn't help and he is not the most organised of people. :-)

As a sporting star who already plays for his country..then the options may be much improved...(sporting work permit wise)

Assuming the VISA application is a team one - then there is a very high likelihood that his case will succeed.

I am not sure whether Rugby7's is 'union' or 'Rugby league'

But, assuming he comes in June it would be nice if you arranged for him to undergo trials with one of the UK national teams - or arrange for him to meet a 'rugby' agent..then the rest may be history -

My advise assumes that he holds a first team position - and not in the reserves.

If you eventually decide to go the 'marriage' route in the future - assuming that the 'sports' work permit does not work out then you will have to:

a) Keep copies of your e-mails and letters to each other

b)take photos with him both in the UK and Tonga - this will obviously involve you visiting him in Tonga.

c) Keep a 'dairy' of all your communications - you may also need to remember the date you met and how you met - so dont throw away your 'girly' dairies

d) keep all those letters/e-mails from your friends - especially the ones were HIS name is mentioned

you will need all this information - if he ever needs a 'spouse/Fiace' Visa in the future
