Hi all,

I would like to share my experience of getting my ILR after having been on different types of visa categories over the past 4 years.

I started off with a year and few months on WP, then switched to Dependent with Spouse on WP for almost a year, back to WP and then finally on HSMP for last month and a half of my 4-year stay in the UK.

I wasn't aware that being on HSMP allowed me to combine all of the above Categories and apply for ILR at the end of 4 years of continuous stay, till I saw the post by TVT on this issue.

I got my papers in order and went to Croydon yesterday. I reached there at 8:30, went in at about 12:00 noon.

The Caseworker assigned to me didn't know about the Amalgamation under HSMP. But I had taken printouts of the IND rules (thank you, Kayalami). I showed these to the Caseworker who then told me that it'll need a senior caseworker.

A little after 5:00 p.m., I was told that all was in order and that I would be granted the ILR.

I found the Caseworker to be very helpful, though it was a complicated case, they were open enough to consider my case.

I had taken almost every document that has been mentioned on this forum, which included Bank statements, employer letter, house papers, tax slips, pay slips, marriage certificate and work permits / hsmp docs. In addition to this I had prepared a cover letter that stated the Category I was applying under and the different categories I had been under for the past 4 years. I took my cue from the Rule 135G on the IND pages - http://www.ind.homeoffice.gov.uk/default.asp?PageId=3201 and clearly stated how I fulfilled all the conditions laid down by them. I think that helped.

I take this opportunity to thank Kayalami, TVT, Joseph and the all the contributors to this forum. I was able to get my HSMP first and ILR now by posting just a couple of queries, which shows the wealth of information that is available on this forum.

Kind regards,
VikB

Vick,

Many congratulations on your success. I think a special word of thanks is due to TVT for highlighting the amalgamation. I am also glad to hear that you took a print out of the rules with you - I hope it wasn't the post on the subject was it .

AFAIK the ILR route through HSMP never allowed amalgamation of time on any other leave except WP. Given the European dimension whistleblower scandal at Sheffield it may be that this was slipped into the rules without any notification - the reaction of the caseworker would lead me to view this as an amendment. It would seem that getting HSMP even for a month is now a way of getting ILR with minimal time as a dependent on any settlement category. Did you include your spouse and dependent children in the application so they could get ILR in line with you.

Any yes, my spouse was included in my application! Didn't want to have to shell 250 quid again!!
