I was just laid off by my company and I have already worked in the netherlands for one year. I want to ask:

1. Do I need to let the immigration office know that I have been laid off?
2. I am a foreigner. If I applied for unemployment benefits, I will be sent by the police to outside netherland or not?
3. Because I got work permit of netherland before, I have to apply for another work permit (if I am lucky to get a job). how long is the process? Do I need to leave the country to wait for the new work permit?
regards,
mike

HI Mikemike

SOrry to hear about your job loss. Technically you have lost the work permit then, as well.

In response to your questions:

1) You do not necessarily need to let the immigration authorities know that you have been laid off, however, they will probably figure that out and you won't be able to work on that work permit anyway

2) You are unable to apply for unemployment benefits as a non-Dutch citizen unfortunately

3) Yes, your new employer would need to apply for a new work permit for you once you are offered a job. Depending on your nationality and the duration of your visa and residence permit, you may need to leave the country. Usually the processing time for a new work permit is about 5 weeks.

Hope this helps, and good luck with finding a new job!

Thank you elfa Kere. I have further questions.

1. To leave the country. Though I was laid off by my company but I only leave the company after another 4 months. I am still working right now. Therefore, if I get another job and work permit. Do I still need to leave Netherlands to get the visa to come back? If I need to leave the country to pick up the visa. Is it OK for me to stay in the Netherland to work after the new work permit ready, I go aboard to pick my visa?

2. In UK, if you change the job, if you hold work visa. It is ok for you to change your visa inside UK. I do not know the situation in the Netherlands.

2. I have three years residence permit and work permit at the moment.

Thank you.

Hi Mike

To answer all of your questions at once, as long as you hold a valid residence permit (i.e. for up to three years), then you will NOT need to leave the country to get a new visa and you can remain in the Netherlands on your current residence visa and new work permit.

Hope this helps!

Thank you very much.

Since I probably lose my job in the next several months, i want to ask a question regarding permanent residence:

1. If I get a new work permit, after 3 year in total, I can be a permanent resident in the Netherlands or not? Or it has to be counted again since I changed my employer.

2. What is the minimum break for the two work permits (for example 3 months) are allowed for applying permanent residency to count the period together?

Regards,

Mike

That's actually a really good question MikeMike, I'd be interested to know the answer to your last questions.
