We're members of the Europeean Comunity, both me and my wife had born in Portugal. We are living in England for almost two years and we have residence permit for a national of a member state of the EEC.
My wife had a baby a week ago, and we have plans to go to Portugal on August for hollydays.
My question is what kind of document we need for the baby to allow him to travel with us (travelling by plane), and if our son will get british or portuguese nationality. I would like to remember that in August our son will has only 6 months, and because proceeding with any type of documents can take long time,we would like to know also, if we can start now to apply for the documents that the baby needs to travel, and if not which possibility we have to go abroad with him in August.

Thank you so much.

Children born in the UK to British Citizens or those with Permanent Residence (Indefinite Leave To Remain) are British Citizens and are eligible for a British Passport. EEA nationals have a right of residence under community law (which is the permit you have) but under UK law are not permanent residents until they have been granted that status. To get this status you have to work in the UK for 4 years. In your case you should apply to the Portugese Embassy for a document. If you are returning to the UK after a shor time in Portugal you may apply for UK permanent residence in 2 years. Once you have ILR your baby will be a British Citizen.

Safe Journey and Enjoy your holidays.
