I would like to know what this 'new' law is all about. I know that it may not be approved this year but I would like to know exactly how this 'new' law would benefit the non-EU engineers trying to work in Germany!

Hi,

The new law, if it enters into force in the present form, would foresee the introduction of two new immigration categories:

- Highly qualified individuals would be enabled to apply for permanent residency. The "highly qualified" category comprises the following groups: scientists or highly specialized scientific personell and experienced, highly skilled employees with a job offer in excess of two times the maximum contribution benchmark for mandatory health insurance (currently, applicants with annual salaries above 79.200 Euros would qualify under this category).
- A "points based immigration scheme" would be introduced, to allow for additional immigration within the limits set by annual quota. The quota would be adjusted on an annual basis according to Germany's economic interests and its integration capacity. The detailed features of the points system would be determined by a seperate Government regulation, but it is expected that they would not significantly differ from points-based immigration schemes of other countries (such as Australia or Canada), comprising such evaluation criteria as qualification, age, German language skills etc.

As you rightly noted yourself, due to legal and political complications, it is currently impossible to say whether the new immigration law will enter into force in a few weeks time, or it will be delayed until after the election and then modified by a new Government, in which case a revised law would probably enter into force next year, or even later.

I would like to ask you one question: may be, your intention was NOT 79.200 Euros, but 79.200 DM per annum, since 79.200 Euros annualy seems to be unreal salary?

No, I actually meant what I wrote. 79.200 Euros is not at all an unrealistic salary in Germany for very highly skilled specialists or management postitions. Presumably, this is exactly the reason why the German Government intends to make possible a "fast track" permanent residency application for this group of people.

Marcis, thank you for your time and help. I have another question for you. It seems that I qualify under the second category, i.e. "points based immigration scheme". I was wondering if Workpermit can help me in the process, of course in case the law is approved. If so, could you tell me the documents I would need, what could Workpermit do for me, and of course how much money would it cost. Thank you,

Alas, the new law is not yet approved. As soon as it will be, we will publish some information in the news section of our website. Presumably, to help you and other applicants coming under one of the new law's new immigration categories, we will have to wait until the Government enacts an implementation regulation, as the new law only sets a general direction. - Keep yourself informed by following our news section!
