Hi, I am a Canadian working in Germany right now since November. My job was misrepresented to me and therefore I would like to resign before my "probezeit" is over. Can I stay in Germany and look for a new job?

I saw something about a new immigration law, under which I would qualify as a manager. When does this come into effect?

Any info is appreciated!

Dear Bradley,

If you leave your current employment, your work permit will cease to be valid and you would either have to apply for a new work permit or for a self-employed residence permit.

There are no restrictions for foreigners to register a company in Germany; what is more difficult is to obtain a self-employed residence permit afterwards. In other words, you may even register your own company if you are staying in Germany as a tourist, but getting the residence permit to allow you to run the company is a different story.

Along with your application for the residence permit, you would be expected to submit a business plan, as well as your CV and other proof of your professional qualification and experience. In general, applicants are expected to prove that their business idea is viable and will benefit Germany. Processing would take around three months, and we could offer to assist you in your application for a fee of 1000 British Pounds (on a no win - no fee basis). However, that fee would not include your company registration , only your residence permit application. I am sure that the local Chamber of Commerce (Industrie- und Handelskammer) in your city in Germany will be able to give you some good advice on that, or at least point you to some consultants who will be able to help you further.
