Hi everybody,

I'm Indian, married to a EU/EEA (native German) citizen.

I have a 5 year German visa (under the Green Card Scheme): residence and work permit, and I'm currently working and living in Germany.

I have not seen much information on married couples with both EU and non-EU citizenships.

I have the following questions:
1) Does my marriage allow me to live and work in Germany? If so, for how long? Do I need a special work permit?

2) When can I apply for immigration to Germany?

3) Can I continue to work in Germany even if I am not under the Green card scheme (after the 5 years are over)?

Here are my answers:

Question #1:
Yes, if married to a German citizen and living together, you may remain and work in Germany indefinitely. You do not even require a work permit anymore. As the spouse of a German citizen, you may work in Germany without a work permit.


Question #2:
After you would have continuously lived and paid income tax in Germany for 5 years, you can apoply for permanent residence and indefinite work authorisation in Germany. After 8 years, you can become naturalized as a German citizen.

That's under current laws. It is quite possible that things will be further simplified in the near future.

... and please note that your status as the spouse of a German citizen takes precedence over your status as a German Green Card holder (i.e., if your marriage remains in force after 5 years, you will definitely not be asked to leave the country).
