Hi All,

Applying for a British passport from India.

My daughter got a Naturalization certificate in November 2020. Now applying for a British passport from India.
1. Once we got a British passport we can travel to the UK without applying for OCI in India or not?
2. Indian passport expired in October 2020 and not renewal as we Appling for a British passport.
3. We can surrender an Indian passport in the UK once travels to the UK and apply for OCI in the UK.

The OCI is a lifelong visa to visit India. The UK government has no requirement to have OCI. That is a matter for the Indian government, nothing to do with the UK.

Yes, it’s correct, but I need to know when traveling back from India. In the Indian airport, they will allow to travel or not.

Your post misses a lot of details. Do you live permanently in the UK? Where did she gain her citizenship? Are you in India currently? When do you plan to go back to the UK? Have you already applied for a British passport? What was her status before getting citizenship?

You've complicated your situation quite a bit I am afraid.

Let's begin with the basics. If your daughter leaves India with a British passport, it will raise a flag in the immigration system that she (as a foreigner) has no prior record of entry. So, you would have to apply for the OCI and then get clearance from the Indian authorities to leave the country so that you are not detained by immigration. This whole process could take at least 2-3 months. This is the best way out for you.

The second thing to consider: If you do decide to renew her Indian passport and exit the country on an Indian passports, airlines have a mandate to check the visa status of a non-citizen arriving in their country (ie destination country). As her UK visa is no longer valid (you have to surrender her BRP upon gaining citizenship), they can't board her on the plane. Showing them her British naturalisation certificate won't help the airlines as its not a valid travel document - so they will have to refer your case to Indian immigration to assess. Which means you might not make the flight. Even if you did manage to board the flight, UK immigration might give you grief for not travelling on a UK passport into the UK as technically her visa is invalid.

Thank you for your reply,

1. Do you live permanently in the UK? Yes ILR status.
2. Where did she gain her citizenship? Baby got citizenship from India.
3. Are you in India currently? Baby in India currently. Me in the UK
4. When do you plan to go back to the UK? Once after receiving a British passport we are planning for her to get back to the UK
5. Have you already applied for a British passport? We are applying for a British passport end of December 2020.
6. What was her status before getting citizenship? She was born in the UK in Aug 2015, applied for an Indian passport and went to India. We did not apply for any UK visa for the baby and her Indian passport expired in October 2020. My daughter never had a UK visa.

So we need to apply OCI for a baby from India before she leaves India.

You will first have to renounce her Indian citizenship. Make sure you get several notarised copies of her Indian passport before you hand it over during the process.

Then you will need to apply for the OCI at the nearest FRRO office. See https://ociservices.gov.in/

After you get the OCI, you would then have to get clearance to leave the country due to the British Passport not registered in the system when entering the country. Speak to the officers about this when you make the OCI on what needs to be done.

This process will take a few months.
