One monthe gap issue.

Post by ash786 » Wed Nov 10, 2010 11:00 pm

I have read the guidence and it says that if there is a difference of more than 1 months between the migrant current leave to expire and the course start date then the migrnat should return to home country to apply if it is less then migrant shud be fine. My questions are,

1. Does this apply to PSW visa holder or not as in the guidence it says student already in the UK (PSW is not a student).

2. Visa expire: 11th August 2010
Course Start Dtae: 10th September so it would be fine

but migrant apply for the course in June 2010.

3. It says you can apply upto three months before the start date of the course. So if the migrant apply in June 2010 would the one month rule still apply or not.

4. Also what happens if the course start before the leave expire. Does the 1 month rule still applies.

5. Also if you are stuyding a Level 7 MBA do you still need a english language assessment or not. The guidence says below level 6 but i just wanted a 2nd opinion.

Any suggestions will be appreciated.

245ZX. Requirements for leave to remain wrote:(l) The applicant must not be applying for leave to remain for the purpose of studies which would commence more than one month after the applicant's current entry clearance or leave to remain expires
is applicable when applying for leave to remain, both extension or switch.

Thanks for that Vinny. Can you kindly confirm the following,

1. So i am right to say that if the course starts before the applicant expiry dats then the 1 month does not apply at all.

2. If the visa is expiring in aug 2011 (just say sourse starts in June 2011) and the migrant apply before that just say May2011 (u can apply upto three months before the course start date but not more than 3 months). Is that correct?.

3. The money needs to be in the account for 28 consecutive days. I read the guidence and it says the closing balance. Do we need to show the required money for everday upto 28 days or just at the end. I am alittle confused on this one.

Thanks
