options to switch Visa

Post by AHMEDKHILED » Mon May 27, 2024 12:55 am

Hi,

I'm a Tier 1 entrepreneur who received an extension last year. With the deadline to apply for ILR coming up in April 2025, it seems unlikely that I'll meet the requirements due to circumstances beyond my control.

I am wondering what options I have to put in my plan to switch my visa since my business is doing well so far

*current visa ends in July 2025

Thanks

If your business is doing well, then what is preventing you from meeting the requirements for settlement next year?

An alternative may be to switch to skilled worker, if you can find a suitable employer.

Thanks, Vinny for your prompt reply,

the main problem is my stay in the UK is not sufficient to apply to ILR, due to family commitments related to my mother's health condition.

I read this statement in visa casework,

( Tier 1 (Entrepreneur) migrants who have not previously held leave as a Tier 1 (Graduate Entrepreneur) can submit applications to settle before 6 April 2025.
If an application is received after this date, you must check to see if the migrant's last grant of leave was granted after a successful challenge by way of Administrative Review, Appeal or Judicial Review. If so seek advice from policy on how to proceed. )

Does that mean I can still apply after this date under some conditions?

and if I switched to skilled worker will it still lead to ILR settlement in the Future?

Thanks

The Tier 1 (Entrepreneur) path to ILR will close on 6 April 2025.
However, If you switch from Tier 1 (Graduate Entrepreneur) initially, then the closing date for ILR application will be 6 July 2027

The skilled worker route has its own rules but time spent under Tier 1E will count towards ILR under that route.
