Yes yesterday I emailed to CGI Birmingham and today morning they replied. Then I go to VFS Birmingham centre to confirm this they check my documents and said come to your apartment date which is earliest available is 9 of April.
Dear Sir,

You can submit your child's passport application at your nearest VFS center.

Thanks for the confirmation. Just I need one info. Have you renounced your Indian citizenship, means born as an Indian and renounced your citizenship. Reason for the ask is based on the different section only they are allowing it.

Thanks, KIA
Hi KIA
when you say they are allowing in different section , can you please be a bit more elaborate
Regards
SN
I have renounced the Indian citizenship that I have acquired as birth right and it will come under section 8 of the citizenship act. If that's the case, all the minors belong to the adult, the Indian citizenship will be ceased. This is where my case is stacked.

There is another section 9 where the Indian citizenship is terminated and it will not affect the minors. Recently, Delhi high court has given the verdict for this. Refer times of india article.

One more scenario, when the child is born and one of the parent holds British citizenship and another parent is Indian, then the child can have the dual citizenship of British and Indian, until the age of 18.

If you see all the cases, one parent is foreign national. So we need to understand the sultan scenario exactly

Thanks,
KIA

Hi,

But if you acquire the British citizenship and surrender the passport means itself is not renunciation?

Because, after this it's based on the individual to apply oci or not. Kindly confirm

Thanks,

As per the current situation.
1.First Submit your Indian passport.
2.Second steps is renunciation which seems to be in independent Process now as all the section 8 gets applied during that time .
if you click on this link https://indiancitizenshiponline.nic.in/Renounce you will see a pop up message and its asking for the minor details etc.

I spoke with the VFS team this morning and told me of my situation and they were also puzzled and told me to get a written confirmation from the high commission before applying. if you apply now they will only take the application but the case will be pending with the HCI and they will only approve the Minor's passport.

3.After both the process are done you apply for OCI.

****Now if the first step is implicit or explicit nobody is able to answer that even the VFS team . I had dropped an email to HCI but no response yet.

Hi Sultan, Please help with following questions
1)
I thought applicants are allowed to apply for passport renewal in any location from london or Birmingham with application form completed from that respective HCI Birmingham or HCI london , is The reason HCI london told you to contact HCi Birmingham because you competed online application from HCi Birmingham ? Pls confirm.

2) how long HCi Birmingham took to respond back to your email ,

3)what details you have shared in email like to HCi Name, passport number of both child and both parents and application number etc ? Passport surender certificate ?

4) did you check vfs Birmingham post the response from HCi and have they proceeded with your application in super priority (takaal) or standard ?

I had got a call from the VFS today and they told that they are accepting the applications but will not processing until they are getting approval from HCI. They will be taking all the documents but they will not be taking the fees nor the passport. Once they get an approval from HCI then only they will be going ahead with their passport renewal.

Hi

I have mailed the Edinburgh consulate and contacted them via WhatsApp. But got only a standard reply stating - "We are aware of the situation and are working with Ministry of External Affairs to seek further directions in this regard. We will get back once we have further instructions. "

Pls let me know if you have any news or updates. Or have you contacted any legal aid or immigration charities for further options.

Thanks

Shiva,

One reply i got is to apply for British Citizenship for my child, my child is eligible and i have applied...it will take two months and odd to come then i shall apply for Indian visa and travel...I am doing that now...
Actually i was of the view of not having BC for my kid for few more years (Due to some tax complications of property in India)

These ppl are absolutely reckless in bringing a wierd law...i will let you know if i hear about it.
