Hi All,

Our daughter was born in June 2021 in the UK. My wife and I both have ILR but we are Indian citizens.

With our immediate goal to visit India in mind, we have two options to get the necessary immigration clearances for the baby -

1. Get British passport and then get OCI
2. Get birth registered with the indian consulate and then apply for an indian passport.

Can anyone please guide us with what you think will be the quicker option?
Hi

It depends on how urgent it is for you to travel to India.
1. Option 1 to get British passport (around 2 months to get the Registration Certificate + Passport) and then applying for OCI. The wait time for OCI is at least 5-8 weeks. If you apply for British Passport, the only way to enter India currently is with OCI as Tourist visas are currently suspended.
2. You may go with this option and get an Indian Passport quicker. But bear in mind, you will need right of abode to UK for your baby. You might need to apply for UK visa in that case.

I am sorry I can't tell which is best, but tried elaborating the pros and cons for you to decide well. Hope that helps.
Incorrect advice in option 1. The child is automatically British as born in the UK to parents who hold ilr. There is NO requirement to apply to register the child as British first. They can apply for a British passport directly for the child using the one week fast track service.
Thanks CR001. I stand corrected. Is there a fast track for issuing first time British Passport? If the OP chooses to apply for Indian Passport, what happens to the British citizenship? Is it nullified?
Thank you both for your replies.

If we decide to go down the indian passport approach, would we need to apply for a UK visa before going to India or can that be done before coming back to the UK?

On top of the time for both these options, there is a 2 month wait time to get the birth certificate at the council registrar.
I'd seriously urge you to reconsider. For getting the indian passport, you will need to get the birth registered by HCI and then use that registration to apply for the passport. Then you will need to apply the visa to enter the UK again, perhaps apply for BC registration, apply for british passport and surrender Indian passport. Really not worth the hassle.

Just apply for the British passport fast track and get a tourist visa to travel.

Hi Aragon1, getting the British passport and a tourist visa was our original plan but the Indian government has suspended issuing tourist visas.

Hi Aragon1, getting the British passport and a tourist visa was our original plan but the Indian government has suspended issuing tourist visas.
Hi Arun

I agree with Aragon1 . It would be faster to get British Passport in a week and then apply for OCI. As you rightly mentioned, tourist visa is suspended. But if you manage to get a quick appointment, getting OCI will be faster than the hassle of registering birth with HCI. I don't know where you are based, but Goswell has appointment available for July 29 earliest. You can submit application in any VFS office as long as you have filled the form based on your jurisdiction.
In general, the next available appointment is around 6-7 weeks with VFS. Please consider this time too if applying for OCI.

I have applied for OCI and it's under process. But the automated email does mention, "IF ANY EMERGENCY, MAY PLS DROP US AN EMAIL AT INF.BIRMINGHAM@MEA.GOV.IN WITH YOUR OCI FILE NUMBER IN SUBJECT LINE AND REASON OF URGENCY IN SUBJECT CONTENT."

This means that even OCI can be processed faster if you can prove emergency to the consulate. There are few options here as well.

Thanks

Hi,

Does anyone know what are the timelines to receive the original documents (UK passport and Surrender Certificate) back?
I submitted my application to Bradford VFS last Monday (28th June 2021) and they provided the Royamail prepaid envelopes but the tracking still doesn't show any data.

VFS person said they will send it to Birmingham and I should get them back in 7 days and OCI will take few weeks.

No, it was DX Courier from VFS. I have never heard VFS using Royal Mail. They use DX Courier.

Why don't you email CGI Birmingham and ask for the status? They do reply.

they don't use royal mail but it was on the list of documents required so we took out envelopes with royal mail stamps ( 2 pre-paid self-addressed envelopes https://www.hcilondon.gov.in/docs/16052 ... 112020.pdf)

And VFS made us sign a document that said they are not responsible if Royalmail fails to deliver us the documents. I wonder if that is to promote the DX service.

Did you get any SMS about application progress?
I don't see any useful status on https://ociservices.gov.in/statusEnqury either.. all it say UNDER-PROCESS

I didn't get any email or sms about returning the documents i.e british passport and surrender certificate. It was delivered and I had not monitored.
You wont get the updates about returning the documents on the ociservices website.

I used Royal Mail silver Next day delivery. I submitted on 17th June (Thursday at 10.30am) received the original document on 22nd June, after the weekend. I suggest you contact them to find out the status of your original document. All the best.

The email did the trick.. got a response from the OCI team that the email is forwarded to VFS and they will respond but got the documents today before any response from the VFS.
The tracking shows the packet was sent yesterday evening and the reply to the email was in yesterday morning so sending an email definitely helped.

Now will wait for the OCI to arrive.

That's great to know! Hope everything goes well with your OCI too. Expect an average wait time of 6-7 weeks based on my personal experience.

Hi

Same here... Mine shows as dispatched on 9th July but no update after that either. Looking at updates on this thread, it looks like the OCI Cards arrive in UK on same day of dispatch in most of the cases.

Could you please tell where did you apply? London, B'ham?

Thanks
