Urgent advice-Renouncing Britisg Citizenship for Indian

Urgent advice-Renouncing Britisg Citizenship for Indian

would appreciate some urgent advice.

I am an Indian national living in Uk for the last 10 yrs.I recently one month ago took British citizenship by naturalisation and was thinking of applying for a British passport and OCI card,however now I regret having taken the citizenship and feel very depressed becoming a foreigner in my own county India where I finally plan to setlle in the next few years.I also took citizenship for my son and only now came to know that he cannot renounce it before 18 yrs.I know OCI does provide benefits but I simply cannot imagine myself being a foreigner in my own country and this made me feel very anxious,Also I did research and came to know although eligible with OCI ,it may be difficult to reclaim the Indian citizenship even after renouncing British citizenship ,So now I am thinking of renouncing the British Citizenship (may take couple of months) and retain my Indian nationality and citizenship.

My question is Would there be any problem as I would have been British only for a few months and haven’t yet surrendered my Indian passport.Also can I apply for my sons Indian citizenship later on but before he is 18 yrs.

I don't know what other people's experience has been with OCI, but I think you can settle in India, but not own agricultural land.

If you only have ILR and leave the UK and do not return to live within two years, you can lose the ILR.

Thanks for your reply.I know about the benefits of OCI and that I can apply for Indian citizenship in 5 years,But What I wanted to know is If I renounce British citizenship in just 2-3 months Can I continue to be an Indian and hold Indian passport or is that against law.Moreover once I return to India I donnt have any plans to come back

Don't be so sentimental.

It hardly matters whether you have OCI or true Indian passport.

A British passport offers many advantages around the world (and especially in EU) compared to Indian passport.

Theoretically, you already lost Indian citizenship as soon as you took British citizenship. I wonder what Indian authority will think about you when they hear all these stories during your Indian passport renewal (if you renounce your British citizenship before that).

Before you do anything, take a look at R2I forum and this issue has been discussed to death there. :)
Moreover once I return to India I donnt have any plans to come back
No one can predict future. It is better to keep all options open.

I appreciate about the advantages of British Citizenship,But As I am planning to settle in India It is not much of use to me(didnt think of this earlier as thought OCI would give most benefits which unfortunatley It doesnt)I have a daughter whose prospects and career I ma have spoiled by taking British Citizenship for him as on OCI She is not eligible for any entrance exams of state and only eligible in NRI quota which no good govt educational instituitions have.

Also Does anyone know If my daughter can regain her Indian citizenship before she is 18 years as This will be relevant as to be eligible for state entrance exams yu have to be an Inidan national ,They are not allowing OCIs ,I wish I had known this earlier,I would never have taken British Citizenship,because she cant renounce before 18yrs ,But can she register as an Indian citizen?

Would appreciate advice

As per my understanding, OCI candidates are eligible for joint entrance and other similar exams. You may need to pay NRI fees though.

By the time your children reaches that age, rules may change.

As I said before, you need to ask this in R2I club forum (Google it for the link) and post the question there.

(i) A multiple entry, multi-purpose life long visa for visiting India.
(ii) Exemption from registration with local police authorities for
any length of stay in India.

financial and educational fields except in relation to acquisition
of agricultural or plantation properties.

parity with NRIs for OCIs is a misnomer as OCIs are not Indian citizen.If you ckeck Maharasthra State Medical Entrance eligibility and Gujrat state CET eligibilty on their websites It clearly says Only Indian nationals are eligible and moreover adds that OCI/PIO are not eligible for these exams through which you can gain admissions in professional courses..NRI quota exists only in a few private colleges and they charge exhorbitant fees.So essentially OCIs are not par with NRIs in educational field.It is only a lifelong visa which If not stamped on your current passport you risk being deported from your own country of birth.This is very sad.

What is done .. is done!

1. You cannot (re)acquire Indian citizenship until you fulfil the requirements.
2. Your child cannot renounce British citizenship until he/she is 18, and therefore, will not be able to acquire Indian citizenship until then - even if he/she may otherwise qualify - unless India changes its laws before then to allow dual citizenship.

Its like 1 way traffic, its difficult to get British Citizenship but more difficult to get Indian Citizenship (due to loads of rubbish bureaucracy and corruption)

I think the only way you can get Indian Citizenship now is through Naturalization


Citizenship of India by naturalization can be acquired by a foreigner (not illegal migrant) who is ordinarily resident in India for TWELVE YEARS (throughout the period of twelve months immediately preceding the date of application and for ELEVEN YEARS in the aggregate in the FOURTEEN YEARS preceding the twelve months) and other qualifications as specified in Third Schedule to the Act. Application shall be made in Form-XII.

I am in same boat as you. I got ILR and my baby boy got citizenship. But I don't want British passport for him so I am going to apply for Indian passport next week. If they ask for home office letter confirming that he didn't get citizenship then I will be in problem otherwise it should be fine. I want to stay in India for few years got bored after staying in UK for more than 10years. Unless conditions are horrible I am planning to settle there for ever.

Legally once you took British citizenship you lost Indian citizenship. But I don't think Indian consulate has this information. so if you renounce british citizenship (you can claim back british citizenship after renouncing anytime you like) you should be fine to carry your Indian passport and hold it (It is only my opinion and not legally right).

To take back Indian citizenship after losing it you need to stay one year out of 5year period in India. So if you lost Indian citizenship now you can get it back legally after 5years.

If your son is already British, he can't get Indian passport as he is not an Indian citizen.

I shall be very interested to know if they issue Indian passport for your son. As per Indian citizenship act, it is not possible.

Refer to Indian Citizenship rules on Home Ministry's website. Consult with an expert on the following scenario where it states that one can apply to get Indian citizenship back after residing in India for One Year, if they were earlier a citizen of India.

They are exempted, this does not mean not eligible. They can still get the seats without the exam and there is a quota.

I think a child can hold both an Indian & British passport simultaneously until he/she reaches 18 years and it is then that they have to decide & choose one nationality. I am sure this has been mentioned a few times on this forum with the appropriate link to the document from Indian Govt. This is probably due to the fact that children can gain citizenship by descent from their parents and as this is involuntary they have a right to choose when they reach maturity.

In AP (Andhra Pradesh) Engineering Agriculture and Medicine Common Entrance Test (EAMCET 2012) OCI/PIO card holders are eligible for entrance test

Hi,

You can not have both passports . India does not allow dual citizenship and will probably never allow it. OCI should do for anything your daughter would need. There is always loads of discussion about seats in good colleges etc it really does not make the slightest difference if you are living in India and have an OCI, in terms of education.
