Out of countryRMLT- Tier 4 to Tier 2 application (withdrawn)

Hi guys,
My question is can my employer apply for tier 2 restricted COS for me and claim exemption from RMLT as my last leave was on tier 4. I gained two qualifications under tier 4 from UK both from recognized universities.
My employer applied for tier 2 for me but because of uncertain urgent matters I had to withdraw my application and return to my country, as they were taking long (I applied via premium service and it still took them 6 weeks and they were unsure still as to when they would make a decision).

So can my employer get an exemption for RMLT because my last stay was under tier 4.
(Detailed answers will be appreciated, a blunt answer wouldn't help.)

It has expired however when I last applied for tier 2 it was still valid. I withdrew my application in last week of September.
