Outside the UK for more than 90 days - can application delayed?

Post by Mayur1 » Sun May 12, 2019 9:23 pm

Team,

I have a question in relation to time spent outside the UK. The scenario is as follows;
- ILR granted on 1st Jan 19
- After ILR Outside UK for 120 days ( Feb 19 to May 19)
- Including this 120 days total outside the UK stay for the last 5 years not more than 450days.

My understanding is, in order to satisfy the below condition, UK citizenship application can be submitted in March 2020 (instead of Jan 2020);
1) spent more than 450 days outside the UK during those 5 years
2) spent more than 90 days outside the UK in the last 12 months

Need help to get confirmation on my understanding of the above rules.

Thanks,
Mayur

Its simple. The day you apply you should not exceed 90 days in the immediate previous last 12 months and should not exceed 450 days in the last 5 years. Also, you should be present in UK on the first day when the 5 year qualifying period starts. Just calculate according to that. You can apply BC when ever you want not necessarily exactly after 12 months.

Hi,

Thank you for quick response on this, it is very helpful.

So just to confirm, "You must not have had more than 90 days outside the UK in the 12-month period before making the application" rule applicable only on the date BC application is submitted
i.e. for scenarios when absences exceed 90 days from ILR date, then just by delaying BC application, the above criteria can be met, correct?

Sorry for repeating question but wanted to get sure before actually exceeding 90 days!

Many thanks,
Mayur

Correct. The absence limits for citizenship count for the period immediately preceding date of application and payment online.

There is no mandatory requirement to apply for citizenship and you can apply at any time in the future, there is not 'cut off' applicable.
