HI.. i jst joind ds site as it seems to be giving up plnty of gud information....

Here is the problem now...my cousin came here on a student visa and now his visa has expried and it`s been 6 months he`s stayin in uk illegly.. he wants to go bak to his country bt is afraid of wot wuold happn wd him..evn i dont knw wot shld he do...plz suggest asap...if there is any legal way out for this wdout ny problem so he can travel to other countries as usual..and to uk as well..

No problem, the UK does not currently have embarkation controls, so he can just leave. There will be no UK exit stamp put into his passport.

This is a plan for embarkation controls to be reintroduced but I don't think they have yet announced a date for that to happen.

Your "illegal" immigrant of a cousin should not have any problem getting out of the UK, he should just board a plane out of the country, there are no immigration checks when leaving the UK.

Regards coming back to the UK, he could have problems as he has already breached immigration laws previously. Other countries-will depend on a case by case basis.

Actually there are outbound immigration checks; they were introduced on 8 July for a brief period after the bombings, then discontinued. Last week they were reintroduced again after the failed bombing attempts and I believe they are still in effect.

I experienced the outbound immigration check on 8 July (very superficial but major delays nonetheless) and I don't think you have to worry. Their main purpose is to catch escaping terrorists, not overstayers.

I wouldn't be surprised that outbound checks be made permanent. They were part of the conservative agenda and recent events are making the idea more attractive.

hey all... thnx a lot for reply..i do appreciate ur time and concern shown on this matter...he`s a national of australia and he had talk wd 1 of the solicitor and he suggestd nt to leave country like ths as it could lead more trouble for him...solicitor says if he makes a petition for apology and try to get his visa extended frm here through suim legal ways it could be all ok for him.. bt personally i`m nt very sure abt this...plz suggest if there is ny case or way out as the solicitor is saying.....

Thanks for the new info. Does that mean that your Non UK/EEA passport gets stamped with the triangle "Exit" stamp like they used to do before in the 90's?

i guess tht`s wot tht solicitor told him...i`m nt sure abt tht ..bt if this is the case wot would happen really wd him?? would he be able to visit ny other EU country again or US??how tht stamp can be removed?? if he looses his passprot and gets a new passport issued would tht help him in aus.?

No stamping on departure, just a cursory check which was probably helped by my having ILR. I got the impression they were looking for terrorists.

I think the easiest way to leave without any immegration checks is via the Eurostar, but perhaps this has changed as well.
