AM I Over Stayer? for ILR Clock

WP Approved 12 Mar 2004 and LTR 14 March 2004 to 23 Jan 2005

Applied for extension(thru employer) sent passport to Home office on 5th Jan 2005 , It is approved and got a letter from HO and my passport with LTR. Not a WP copy. Just letter stating that my WP has been approved dated 25 Jan 2005

LTR started from 25-Jan-2005

But only one day gap between these two LTR. Does it affect my ILR?

Any suggestion's or How do I clarify this and whom to contact to clarify.

Can you confirm that on 5th Jan, your employer applied for the WP extension and you applied for FLR at the same time?

I have sent form and passport 1st week of Jan 2005 to my employer I dont know, how to clariy employer sent FLR before expiry.(i.e application date)

Since I have got only one day gap between two FLR, thats is 24-Jan-2005 and FLR done by HO on 25-Jan-2005, I can safely assume that, my passport should have held with HO by that time.

Any friends here can give any direction about how to find my application date

Yes, given that you got your LTR on the 25th Jan 05, it's very likely that your employer sent your application before 23rd.

Can you ask your employer if they applied directly or through an immigration service and if they have any proof of postage?

If you want to be absolutely sure, you can do a SAR and you will see the date that the app was received. But it does look very unlikely that there is a "gap" in your LTR.

The BIA has changed their website. The closest thing is http://www.bia.homeoffice.gov.uk/navigation/foi/. But be careful, you need to do the Subject Access Request under the "Data Protection Act". not the "Freedom of Information Act" that is so prominent on that page.

If you do the latter, their official guideline is to reject your request and point you to the Data Protection Act.

Thanks for such a quick reply, Do you have any template to make this request to know my visa continuity and when the application was made.

Do I need to send Email or Physical Letter. Please do the needful. ANy template would be really helpful.
