Overseas Domestic Worker

Hi

I'm a British citizen and my wife is and Indian citizen. My mother in law is coming to visit us for a few months and as she has joint and muscle issues, she has a maid who looks after her so we would like to get an overseas Domestic worker visa for the maid.

There is a 5% probability that the maid will not be able to come, so my question is, if the maid cannot come due to a member of her family being ill, is the domestic worker endorsed on my mother in law's visa? Also, if the maid does come and stays longer than my mother in law, would that be a problem as long as she leaves before the visa ends?

The domestic worker visa is given to the maid, not your mother-in-law. So, to begin with, the maid must have a passport.

She also needs to have worked for your mother-in-law for at least a year.

There will need to be a written contract between the maid and her employer (presumably your mother in law).

She will need to be paid the UK minimum wage of £6.80 per hour while she is in the UK, not work more than the hours specified in the Working Time Directive (48 hours a week) and would also be entitled to holiday pay, like a normal British worker.

She will also need to pass the English speaking and listening requirements at B1 on the CEFR scale. That is about 4 out of 9 on the IELTS scale.

Yes. The maid's visa is dependant on her employer's stay, so if her employer leaves, she must leave too. She is also not allowed to change employers while she is in the UK. So, she can not transition from working for your mother in law to working for your wife or yourself, for instance.

The English language requirements do not apply unless the Overseas Domestic Worker in a Private Household (ODWIPH) is applying to settle, and since 05-Apr-12 ODWIPHs cannot settle in the UK.
