overstay 20years application denied

Post by whatamitodo » Thu Apr 03, 2014 8:23 am

Im 22 years old and have been in the uk since i was young. It was only when i turned teenager i realised my status as my parents never told me. Basically saying we are overstayers. My mother couldnt afford the fees to make our stay legal and was to scared to approach anyone at the fear of getting deported. So i started the process of getting things sorted on my own. I approached the solicitors and they advised i apply for discrtionary leave to remain as the 14 year rule which would have entitled me to indefinate leave to remain had been abolished.

I see myself as british. The way i act. My accent everything, there is no trace of my own culture. I have friends here. I have a boyfriend. Neither of them know my status and assume I am british. I cant even tell them.

Long story short. My application was denied. Even though I had medical evidence dating back to 1991. I have received nasty letters saying i am going to be removed.

I have worked previously.Paid taxes using all my own documents.i have never been in trouble. I have gone through the education system leading up to A levels.

So my solicitor applied for judicial review. A few months later the ukba wrote asking me to withdraw the application and the will review the case. They said it could take up to 3 months. Im scared they will reject my application again.

Anyone else happen to be in the same boat?.

Well it's not discretionary leave to remain, it's leave under:
276ADE (1). wrote:
(iii) has lived continuously in the UK for at least 20 years (discounting any period of
imprisonment)

or

(v) is aged 18 years or above and under 25 years and has spent at least half of his life
living continuously in the UK (discounting any period of imprisonment)
If you can show you meet the requirement, you'll be granted 2.5 years leave on a 10 year route to settlement.

You said that you study and work and pay taxes. So just for information then how you have been proving your right of work & live when admitting in school and finding work?

I don't know how home office is going t deal with such application someone with over staying of 22 years and 8 months .despite that during that time so many times there were amnesty introduced for illegals to regularize and specially for family with children .
did you have a insurance number and how you were paying tax etc . and how you are proving your residence in uk apart from doctors registration .

its better if you make application for all of your family as it looks to me under 14 years rule if you qualify so rest of your family too .
You may have to fight a battle more than once to win it.

The '14 year rule' no longer exists!

Honestly i dont know how its happened. Of course there was a time when we were legal. So I have my national insurance number. Through sheer luck i have gotten by..like i said people assume i am english in the past so ive managed to get a job/go to school without many questions.i just got asked for my national insurance number. The place i worked for a few years has gone to administration and now of course im unemployed .Things have got stricter, workplaces are a bit more aware in regards to proving your right to work and live. I cant work. I know that but otherwise i would not have been able to pay the fees. So now im just waiting for the decision.

I hate my situation. But at least ive done the right thing by trying to get it sorted. I was only young. I didn't know.
