Overstayer advised to go home and re apply for visa

My husband is Jamaica and has been in the uk for over 11 years as an overstayer. We got married in 2002 and have 2 children together (I am British born) and he has another child from previous relationship. We submitted a visa application to HO over 2 years ago to apply for ILR. As yet they have not processed his claim.

Due to a family emergency he has decided to retun home. Due to the nature of the emergency he asked the local MP to apply forto apply to the HO for permission to return to Jamaica and be granted permission to come back due to family and work commitments. They advised him to cancel his current application and request the return of his passport in order for him to go back to Jamaica.

I am concerned that he will get to Jamaica and have to start the whole visa application process again. Does anyone have any idea how long it could take applying from abroad. Is this advice in his best interest. I am worried that he may return to Jamaica and have problems coming back.

Between a rock and a hard place...

1, From Jamaica settlement visa denial rates are running at 66%, and these figures are before the ECO went tough on overstayers based on recent evidence.

2, It does seem overstaying is being used a sole reason to deny settlement visas.

3, I'd say hang on until he reaches the 14 year stay concession, but the worry there is will there be a 14 yr concession in three years time..?
