married a year and a half ago to abritish national before the COA was introduced, been together 4 about 3 1/2 now ive overstayed a visiting visa for about 6 years now and decided to go home and apply for spouse visa. she works full time and not on benefit but is tax credit

1. will it be an advantage for me for the fact that we own a house together but she pays the mortgage as i do not work at the moment.

2.will it be an advantage for me if someone can offer me a job here so i can show it to ECO back home.

3. is there a set limit on the amount of her yearly wages.


i have all relevant documents needed but im a bit shakey on the basis of having to have overstayed for 6 yrs, will i have to go through a rough scrutiny on that basis.

any clue wot i should do

there are so many good examples on this forum - where spouses have gone back home and successfully returned. Search the forum.

can an overstayer really come back?

i've been reading through many threads on the forum concerning overstayers who have gone back to their home countries to apply to join their spouses. its encouraging to read all the success stories, think i've read all of them.

but i must say kenya appears to be a difficult country to apply for a spouse visa. someone told me the refusal rate for spouse visas is so high even without mention of the word overstaying.

while overstaying is wrong, i do wonder....they never bother to look at all the things i've read in the success stories, or such things as family ties such as children, length of relationship etc....is it that their is no uniformity in the system, given the fact that some african countries do have some success stories. i've read in this forum that if applying for CLS past immigration history for instance overstaying does not necessarily mean you wont get a visa. But i understand for bhc nairobi-overstaying can marr everything else-indeed scary
