Overstayer with son. Please Help!

Post by sistasista » Fri Apr 02, 2010 8:50 pm

I hope someone can help. It is a bit complicated so i will try and make it clear.

I am a Jamaican female in my mid-thirties

2000 - My boyfriend - a British Citizen - sent for me but I was only allowed to stay for 24 hours in the UK. I did not go back. I wanted to try and make a better life for me and my young son. (My boyfriend and I were together for a few years but things didn't work out. We were going to get married but in the end I was the one who called it off.)

2002 - My son has a relative in England on his fathers side. He sent for my son when my son was five years old. He was granted a 6 month stay. The babyfather in Jamaica is no good and did does not look after my son.
At the end of the 6 months I didn't want my son to go back so I spoke to the uncle and he let him live with me.

I know it is not a good situation. My son regards England as his home and I don't know what to do. He is now a teenager and I am worried about his future. I would like us to stay in England. I don't know what to do or where to start?

You need to get immigration advice from a solicitor or OISC registered immigration advisor because these cases are not straight forward.

How long have you been UK? 14 years unlawful residence may be the route for you.Speak to a very good lawyer not those who are interested in money.

Thank you for responding. I have been here for 10 years. I will take your advice and seek legal help.

Can anyone give me an idea of what is the worst that could happen and what is the best that could happen?
