Overstayer with EU wife and child

Post by Youssef2015 » Wed Jul 01, 2015 10:01 am

Hello I hope someone can help me

I'm a Moroccan citizen living in Holland/Netherlands with my Dutch wife and baby, last year i applied for a Schengen visa from Morocco on the rights of being a family member of eu/eea citizen, however was turned down from French and Spanish embassies, finally i hired a lawyer who helped me get the visa from the norway embassy under the same rights, I used to visa to come to Holland to b with my wife as she was heavily pregnant however I could not leave and miss the birth of our first child because of the nightmare I went through to get a visa in the first place,

So I overstayed the schengen visa by 6 months now and i would love nothing more then to get a residency sorted out asap so I can live work here in holland and support my family the best I can.

Can anyone give me some good advise, or if anyone knows any top dutch immigration lawyers please let me know

Thank you very much

Well, for overstaying is a fine of 500+ euros, plus a possible ban into the schengen area of 1 to 3 years on cases 5 years, depending on the country it happens, sooner or later they will catch you, is only a matter of when, I guess that having a Dutch wife could help you out, good luck

I was turned down by the Spanish embassy because they said that my marriage had to be registered in the Netherlands first, and the French embassy wouldn't even accept my documents, they said that i would still need to show bank statements and flight tickets est,
same thing happened to me at the Belgium embassy, seems like they just make up rules instead of sticking to them!
so in all it took me about 6 months of running around to different embassies in Morocco it was a horrible experience!

I am sure that you did not correctly apply to the french embassy, that is why they did not accept your application.

Although there are some people who are from other countries, but on this forum, most people are from UK. So, most of the info and discussion are geared towards UK immigration.

The best way would be to find some information in Netherlands locally.

Is it possible that you and your wife could move to another eu country for about 6 months and live and work there?
Do you have friends or relatives in france, who could help you find a job in france? or any other eu country? If so, then there could be an easier way forward for you.

Thank you for your reply,

No i don't have family in France, however we are looking in to moving to Germany, my wife is currently looking for a job there, if she gets a job offer then we will go there and hopefully get the permit
