Is Paid Appeal Possible after 8Months

Post by Hamid Raza » Thu Dec 23, 2004 3:35 pm

I got rejection letter in April 2003. They gave me 35 points in experience and these were my only points. I am B.A, so no points for education. I was not given points for past earnings due to lack of supporting documents. I was told by the HSMP team that they didn’t demand extra documents because even if I got 25 points for past earnings, I couldn’t have qualified. My wife is doing a graduate level job. The condition of living together for two years has now been fulfilled. So, now I can get the required points as I can prove my past earnings and can get points for spouse achievements.
Will I have to apply again or can I file an appeal against the decision by repaying the fee and providing the above mentioned documents. If any body knows about this matter, please answer me. I shall be highly thankful.

My understanding is that a paid appeal is a new application because you are submitting new documentary evidence. However, I also understand that a re-application/paid appeal retains the same reference number as the initial application.

It makes sense to me to approach your re-try of HSMP as a new application because you are now going to be presenting earnings information, which must go back 12 months -- that is, the 12 months prior to today (or the current date), yes? (That is, not 12 months prior to the date of the original application.)

Plus, if you are only now able to show 2 years of living as a married couple, it again makes sense to me that the new application would be dated at the current date rather than from April.

I suggest that you do a "search" (see the options located below the "immigrationboards.com" banner above) and ask the computer to look for all posts with the words "paid appeal" in them. :)

Hope this helps! Good luck!

When you file an appeal against a negative decision by repaying the fee and submitting documents not included with the original application, that is a paid appeal -- that is my understanding.

Why can you not claim points for your B.A.?
