My parents got refused family visitor visa!!!!

Post by jSidhu » Sat Aug 01, 2015 6:16 am

My parents too got refused for visitor visa this month.

I am on Tier 2 dependent visa and my husband is on Tier 2 visa and we both are working in IT firms and staying in UK for 3 years.

Here are the reasons for refusal for my mother's application:

1) You have lodged an application to visit to UK for one month to visit your son and his family. Whilst I understand the importance of family visits under the UK immigration rules, you must show that you qualify for a visa by explaining your own circumstances and the plans you have for your visit. Your sponsor is only one element of the application, I must assess the information you have provided about yourself separately from your sponsor’s part of your application.

2) You have stated that you are supported by spouse/partner/other but you have not specified who this person is. Your spouse has lodged a visit visa application alongside yours he has also stated that he is supported by spouse/partner/other but has not specified by whom. You have stated that you do not receive any additional income from property/stocks or shares and that your monthly expenditure on living cost is £100 however the documents you have provided do not demonstrate what your monthly income is, nor do they demonstrate the source of this income. Based on the information before me including statements made by you on your visa application form, it appears that your income is nil and that your expenditure of £100 per month leave you in deficit.

3) As evidence of your financial circumstances you have submitted a bank statement in your husband’s name from the State Bank Of India for account ending 5772., showing a closing balance on 22/08/2015 of Rs.213771.75(approx £2167.14 as per Oanda rate of exchange on 21/07/2015). I note that on the 08/06/2015 there was a large cash deposit of Rs 150000(£1520.64)- which is described in your statement as ‘cash deposit self’, you have not provided any satisfactory explanation as to where these funds have come from. I note that you have stated that your son will cover all the associated costs of the trip, however the documents you have provided with your application do not demonstrate that these funds have come from him.

4) In light of the above I am not satisfied as to the origin of these funds, nor am I satisfied that these funds are genuinely available to you and your spouse. Moreover, I am not satisfied that you have provided a true reflection of your personal and financial circumstances in India. As such I am not satisfied that you are a genuine visitor travelling to the UK for a limited period as claimed.

A similar reason is given for my father's application ( Yes, officer simply copy pasted the reason and didn't even see that my mother has attached her own bank account stmts not for my father's account as stated in refusal letter)
Also, officer didn't even bother to read form properly that applicants are going to meet 'son-in-law' not 'son' and throughout refusal letter he/she has been mentioning about 'son' only!

The problem I am going to discuss here is a brand new one & I haven't find any similar posts.
I think our applications were rejected due to misleading fields on 'Visa4UK' website only (mind it, it is a BETA version and still under testing.)

I have lodged a complaint to home office but got an automated sort of reply within a week which wasn't satisfactorily at all, so I further asked explanation of below points:

"1) Under 'Family Details', how can one specify that he/she has non-dependent children?
Because you are only asking that :

Non Dependent Children
'Are any other children travelling with you?'

What if I want to specify that I have non-dependent children but they are not travelling with me?
(Providing this information could explain that applicant will come back to home country as he/she still has strong ties with it)

2) Under 'Employment and Income section' of application

What is your current working status?

Let's say I have selected 'Supported by spouse/partner/other '.
But visa officer in our case have raised objection that we hadn't specified who that person is.
Your form don't even have an extra text field to specify who this 'other' is?
How can one specify that this 'other' is a child of him/her?

3)
Income and Expenditure
Do you have savings, properties or other income, for example from stocks and shares? Do you have savings, properties or other income, for example from stocks and shares?
Yes*
No

Lets say we have 'properties' and selected 'Yes' here.

Then it further asks a mandatory field:
Total Monthly Income From Amount in GBP(£)

What shall one can fill here if applicant owns property but that's not source of monthly income?
Don't you think applicant will rather prefer to select 'No' in above field even if he/she owns property but it is not a source of income?
(which is what we have done in our case too)

Please address above application form related queries which are so misleading that fresh applicant will definitely get it wrong the first time."

Till 30th july, 2015, 'Total monthly income from' dropdown wasn't having a field 'Other sources including friends and family'
(because otherwise we would have mentioned properly from where my parents are getting £100 per month), I suspect they have added this field after my email (just a very wild guess)

Can anyone pls give any suggestion, what shall we do now?

General Visit Visa: Sister Refused but Parents issued visa!

Post by jSidhu » Mon Aug 03, 2015 3:01 pm

Couldn't find how to start a new thread on this website, so asking my question here:

My parents were refused tourist visa last month because ECO was not satisfied with their financial situation.
Being foolish, we didn't any source of income for them however my father is making quite a good income.
Few friends and agents suggested that if you are supporting parents then they don't have to show anything of their own. So being lazy and in order to submit application in hurry, we said they don't earn anything.

Now if file again after 5-6 months, I am worried how can we say that they have started earning. Too much worried because of this silly mistake :(
